Redmi Power Bank Contest Terms and Conditions
TERMS AND CONDITIONS -
This offer (“Offer”) is brought to you by Xiaomi Technology India Private Limited (“Xiaomi” or “we” or “our”). Please read these terms and conditions (“T&Cs”) before entering the Offer. You agree that, by participating in this Offer, you will be bound by these T&Cs and you acknowledge and agree that you satisfy all Offer eligibility requirements as provided hereinbelow.
The Offer is available at www.mi.com, mobile site and related mobile application (“mi.com”).
All participants must participate in the contest to be eligible for the lucky draw.
Offer Period: The Offer will be held from 16th February 2020 to 20th February 2020.
Prizes to be Won: Each Winner will be awarded a new Redmi Power Bank
Selection of Winners: Xiaomi shall, from the list of participants who have participated in the contest during the period, randomly pick names of four (4) lucky winners per day from such list of participants through a luck draw (“Winner(s)”).
Xiaomi shall declare the names of the Winners by 20th March 2020 on mi.com, Xiaomi’s official handles on the social media platforms Instagram, Facebook and Twitter and on Mi Community. The Winners will also be notified by email, phone call or push notifications basis the details provided by the Winners. Xiaomi shall not be responsible for any incorrect details provided by the participants or for any failure or delay in communication caused therefrom.
Xiaomi shall add the product to the designated Mi Account used by the Winner.
If any attempted notification is returned as undeliverable, or if the notified Winner doesn’t respond within the designated time frame, or if any required documents are not submitted within the required time frame, or if the Winner cannot be contacted, verified or found, the Winner will be disqualified from the Offer and Xiaomi will forfeit the concerned Winner’s Prize, and an alternate participant may be declared as Winner, time permitting.
The participants, including the Winners, further agree that Xiaomi shall have the right to retain such information provided by them, use the information for its business/commercial purpose and make copies of the information. Each Winner grants to Xiaomi and Xiaomi’s designees the right to use the concerned Winner’s name, picture, likeness, voice, video, biographical information, and statements, at any time or times, for advertising, trade, publicity and promotional purposes or for any other reason Xiaomi sees fit, without limitation, in all media now known or hereafter discovered, worldwide and on the internet, without additional notice, consent, review or approval, and without additional compensation, unless prohibited by law.
Participation in this Offer is open to only those of you who:
(i) can form legally binding contracts under Indian Contract Act, 1872;
(ii) are residing in India;
(iii) purchase an Eligible Product; and
(iv) Proof of age, identity and place of residence may be required.
Employees of Xiaomi and its affiliates, their immediate family members (spouses, domestic partners, parents, grandparents, siblings, children and grandchildren), and employees of Xiaomi’s advertising agencies and Offer partners are not eligible to participate in this Offer.
Conducting this Offer is prohibited in the state of Tamil Nadu and thus, users residing in the state of Tamil Nadu are not eligible to participate in this Offer.
The Prize is not exchangeable for other rewards, or refundable, replaceable or transferable for cash or credit under any circumstances.
The decision of Xiaomi regarding the winners of the Offer shall be final and binding on all participants.
Xiaomi reserves the right to alter, modify or cancel any T&Cs herein, or modify, terminate or withdraw the Offer at any time during the Offer Period at its sole discretion without prior notice or assigning any reason thereof.
Xiaomi retains the right to contact the participants any time after the expiry of the Offer.
All email correspondence related to the Offer will be made by Xiaomi through its email IDs using the domain [_]@xiaomi.com only. Users are advised not to provide their details to calls/emails from any other ID and Xiaomi will have no liability in relation thereto.
This Offer shall be governed by the laws of India. All disputes with respect to this Offer shall be subject to the exclusive jurisdiction of the courts in Bengaluru, India.
If for any reason the Offer is not capable of running as planned, including but not limited to fire, flood, epidemic, earthquake, explosion, labour dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state or local government law, order or regulation, order of any court or jurisdiction, disruptions caused by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other cause that corrupts, affects or compromises the administration, security, fairness, integrity, proper conduct or intended play of the Offer, Xiaomi reserves the right at its sole discretion to cancel, terminate, modify or suspend the Offer, and select the potential Winner from among all eligible, non-suspect entries received up to that time. Xiaomi also reserves the right to disqualify any individual whom it deems responsible for or related to actual or attempted disruption of or interference with the Offer or its intended operation. Xiaomi assumes no responsibility for any error (including user error), omission, interruption, deletion, defect, delay in operation or transmission, communications failure, theft, lost, failed, incomplete, inaccurate, stolen, misdirected, undelivered, garbled, destruction or unauthorized access to, or alteration of, entries, including any erroneous appearance of qualification for a Prize. In no case will more than the stated number of Prizes be awarded. Xiaomi is not responsible for any problem or technical malfunction of any telephone network or lines, computer online systems, servers or internet service provider, computer equipment, satellite, telephone or cable transmissions, software, failure of any e-mail or entry to be received by Xiaomi due to technical problem or traffic, congestion on the internet or at any website, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this Offer.
XIAOMI DISCLAIMS ALL OTHER REPRESENTATIONS AND WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR USE, AND NON-INFRINGEMENT OF THIRD PARTY INTELLECTUAL PROPERTY RIGHTS. UNDER NO CIRCUMSTANCES, WILL XIAOMI OR ANY OF ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR CONTRACTORS SHALL BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY LOSSES OR DAMAGES ARISING FROM THE OFFER, UNDER TORT, COMMON LAW OR UNDER PUBLIC POLICY, EVEN IF SUCH PARTICIPANT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
