OFFER TERMS AND CONDITIONS

This marketing program (“Offer”) is from KOTAK BANK LIMITED under an arrangement with Xiaomi Technology India Private Limited (“Xiaomi”).

1. ELIGIBLE CUSTOMERS: KOTAK credit card holders, referred to as “Cardholders”. who purchase an Eligible Product under the concerned Offers and meet the conditions set out here are referred to as “Customers”.

2. OFFER PERIOD: 27th September 2022 00:00 hours to 26th Oct, 2022 23:59:59 hours.

1. ELIGIBLE PRODUCTS:

A. For First Offer: Any products being purchased on www.mi.com, the (“Mi Authorised Channel”)

B. For Second Offer: All products listed at Clause 4B shall be individually referred to as an “Eligible Product” and collectively as “Eligible Products”.

Note: First Offer and Second Offer is not applicable on below mentioned products. 1) Redmi 9A Jio 2) Redmi 9A ( 2+ 32)

First Offer Discount of ten (10%) percent, subject to a maximum discount of INR 1250 (Rupees One Thousand Two Hundred Fifty) to each Cardholder for purchases made on the Mi Authorised Channel (defined below) during the Offer Period using their Kotaj debit/credit card or any EMI Scheme using the credit card.

3. Second Offer Following discounts (each a “Discount”) provided to each Cardholder purchasing the concerned Eligible Product on the Mi Authorised Channel (as defined below) during the Offer Period using a Kotak debit/credit card or under a Kotak credit card EMI scheme.

i. For First Offer: To avail the Discount as part of the First Offer, during the Offer Period, a Cardholder’s transaction using his/her Kotak credit/debit card or a Kotak credit card EMI scheme, must be for a minimum value of INR 6,000 (Rupees Six Thousand).

ii. For Second Offer: To avail the Discount on the Eligible Products during the Second Offer, during the Offer Period, a Cardholder’s transaction using his/her Kotak credit /debit card or under a Kotak credit card EMI scheme must be for a minimum transaction amount set out in Clause 4B above.

Other Terms and Conditions:

1. The above Offer is by way of a special offer for Cardholders only.
2. The Offer can be availed only once per Kotak card by each Cardholder during the Offer Period, irrespective of the number of products purchased.
3. The Offer is not applicable on cash on delivery transactions.
4. The Offer is not applicable on net banking transactions.
5. Any person participating in the Offer: a. must be an Indian citizen and resident; b. must be able to enter into legally binding contracts under Indian Contract Act, 1872; c. must hold a valid and unexpired credit card issued by Kotak; d. must purchase an Eligible Product; e. must possess proof of age, identity and place of residence.
6. The Offer cannot be combined with any other offer.
7. The Offer is valid until stocks last.
8. Any person availing this Offer shall be deemed to have accepted these terms and conditions.
9. Delinquent and over-limit Cardholders will not qualify for this Offer.
10. This Offer is non-encashable, non-extendable and non-negotiable.
11. If a Cardholder has more than 1 (one) Kotak card, spends on the cards cannot be clubbed by the card member in order to qualify for the said Offer.
12. Any query regarding the Offer will be entertained only till 12 October, 2022. Post such dates, Xiaomi will not entertain any correspondence or communication regarding this Offer from any persons.
13. Pictures of products shown in the communication sent to the customer either through mailers or advertised on the website, are representative only and may not bear a resemblance to the actual products. None of the parties shall under any circumstances be responsible towards the same.
14. Returned transactions, disputed or unauthorized/fraudulent transactions will not be considered for the Offer.
15. All government levies and taxes shall be payable by the Cardholder as applicable at the time the Offer is availed.
16. Cardholders are not bound in any way to participate in the Offer. Any such participation is voluntary.
17. This Offer shall be subject to all applicable laws, rules and regulations which are in existence and which may be promulgated anytime by any statutory authority.
18. Xiaomi reserve the right, at any time, without prior notice and without assigning any reason whatsoever, to add/alter/modify/change or vary all of these terms and conditions or to replace, wholly or in part, this offer by another offer, whether similar to this Offer or not, or to extend or withdraw it altogether.
19. Any disputes arising out of the Offer shall be subject to the exclusive jurisdiction of the courts at Bangalore.
