OFFER TERMS AND CONDITIONS

This marketing program (“Offer”) is from ICICI Bank Limited (“ICICI”) under an arrangement with Xiaomi Technology India Private Limited (“Xiaomi”).

1. ELIGIBLE CUSTOMERS: ICICI credit card holders are referred to as “Cardholders”. Cardholders who purchase the Eligible Products from the Authorised Channels during the Offer Period and meet the conditions set out under this Annexure are referred to as “Customers”. Offer will not be applicable on Amazon Pay ICICI Bank Credit Card (BIN 431581).
   
   
2. ELIGIBLE PRODUCTS: All products listed at Clause 3 (a) purchased from the Online Channel during the First Offer Period and all products listed at Clause 3 (b) purchased from the Online Channel during the Second Offer Period and all products listed at Clause 3 (c) purchased from the Online Channel during the Third Offer Period and all products listed at Clause 3 (d) purchased from the Online Channel during the Fourth Offer Period is referred to individually as an “Eligible Product”, and collectively as the “Eligible Products”.
   
   
3. OFFER:

First Offer:

a. Following discount (each a “Discount”) to each Cardholder purchasing an Eligible Product through the Online Channel (as defined below) during the First Offer Period.

OFFER PERIOD: 16 October 2021 00:00 hours to 25 October 2021 23:59:59 hours

To avail the Discount on an Eligible Product listed at Clause 3 (a) during the First Offer Period, a Cardholder’s cart must contain Eligible Products of a minimum amount of Indian Rupees Six Thousand (INR 6,000).

Note:

• First Offer is a minimum cart value offer and multiple products can be purchased under this to avail offer as set out in the table above.
• This First Offer will not be available on the Eligible Products provided under Clause 3 (b), 3(c), 3 (d).

Second Offer:

b. Following discount (each a “Discount”) to each Cardholder purchasing an Eligible Product through the Online Channel (as defined below) during the Second Offer Period.

To avail the Discount on an Eligible Product listed at Clause 3 (b) during the Second Offer Period, a Cardholder’s transaction using his/her ICICI credit card or under a credit card EMI scheme, as applicable, must be for the minimum amounts set out in the table above (each a “Minimum Transaction Amount”).

Third Offer:

c. Following discount (each a “Discount”) to each Cardholder purchasing an Eligible Product through the Online Channel (as defined below) during the Third Offer Period.

Fourth Offer:

d. Following discount (each a “Discount”) to each Cardholder purchasing an Eligible Product through the Online Channel (as defined below) during the Fourth Offer Period.

OFFER PERIOD: 15 October 2021 00:00 hours to 25 October 2021 23:59:59 hours

To avail the Discount on an Eligible Product listed at Clause 3 (d) during the Fourth Offer Period, a Cardholder’s transaction using his/her ICICI credit card or under a credit card EMI scheme, as applicable, must be for the minimum amounts set out in the table above (each a “Minimum Transaction Amount”).

Other Terms and Conditions:

1. The above Offer is by way of a special offer for Cardholders only.
2. The Offer can be availed only once per ICICI card during the Offer Periods on the Online Channel, irrespective of the number of products purchased. If the First Offer has been availed, a Cardholder cannot avail the benefits of the Second Offer and Third offer.
3. Any person participating in the Offer:
   a. must be an Indian citizen and resident;
   b. must be able to enter into legally binding contracts under Indian Contract Act, 1872;
   c. must hold a valid and unexpired credit card issued by ICICI;
   d. must purchase an Eligible Product;
   e. must possess proof of age, identity and place of residence.
   
4. Offer is not applicable on cash on delivery transactions, on debit card transactions and on net banking transactions.
5. The Offer cannot be combined with any other offer.
6. Cardholders are not bound in any way to participate in the Offer. Any such participation is voluntary.
7. Any person availing this Offer shall be deemed to have accepted these terms and conditions.
8. Delinquent and over-limit Cardholders will not qualify for this Offer.
9. This Offer is non-encashable, non-extendable and non-negotiable.
10. If a Cardholder has more than 1 (one) ICICI card, spends on the cards cannot be clubbed by the card member in order to qualify for the said Offer.
11. Any query regarding the Offer will be entertained only till 1st November 2021 (23:59:59 hours). Post such dates, the ICICI and Xiaomi will not entertain any correspondence or communication regarding this Offer from any persons.
12. Pictures of products shown in the communication sent to the customers either through mailers or advertised on the website, are representative only and may not bear a resemblance to the actual products. Neither of the Parties shall, under any circumstances, be responsible towards the same.
13. Returned transactions, disputed or unauthorized/fraudulent transactions will not be considered for the Offers.
14. All government levies and taxes shall be payable by the Customers as applicable at the time each Offer is availed.
15. This Offer shall be subject to all applicable laws, rules and regulations which are in existence and which may be promulgated anytime by any statutory authority.
16. Xiaomi reserves the right, at any time, without prior notice and without assigning any reason whatsoever, to add/alter/modify/change or vary all of these terms and conditions or to replace, wholly or in part, this offer by another offer, whether similar to this Offer or not, or to extend or withdraw it altogether.
17. Any disputes arising out of the Offer shall be subject to the exclusive jurisdiction of the courts at Bangalore.
