Trade-in Promotional Campaign Terms and Conditions

 

1.      XIAOMI TRADE-IN PROMOTIONAL CAMPAIGN

1.1.      The trade-in promotional campaign is organized by Xiaomi Technologies Malaysia Sdn Bhd (hereinafter, “Organiser” or “Xiaomi”) which allows the Organiser’s customer (hereinafter, referred to interchangeably as “You” or “Participant”) to trade-in their old devices which includes amongst other phones and tablets (hereinafter, “Devices”) for a certain price as assessed by the Organiser’s partner, CompAsia Sdn Bhd (hereinafter “CompAsia”) and thereafter will get instant discount of the new Xiaomi products purchase price from Organiser (“Campaign”).

1.2.      The trade-in of the Devices carried out between CompAsia and the Participant are performed and facilitated by CompAsia on the basis of the trade-in terms and condition by CompAsia [please refer here at https://my-caecom-microsite-portal.compasia.com/terms-and-conditions (“Trade-in Device T&C”) ]

1.3.      This Campaign will start from September 27th 2024 18:00:00 to October 31st 2024 23:59:59

(collectively, “Campaign Period”). The Organiser reserves the right to shorten, extend or cancel any of the Campaign Period at its sole discretion without prior notice.

1.4.      This Campaign is only applicable to selected Xiaomi products only. The trade-in service is provided solely by CompAsia and the trade-in value of the Devices are solely based on the Device condition and the discretion of CompAsia.

1.5.      Participant agree to comply with all the terms and conditions of this Campaign (“T&C”). The scope of these T&C is limited to the Xiaomi’s role of organizing this Campaign only.

1.6.      This Campaign is on first come first served basis and while stocks last. 

1.7.      Participant agree that the Organiser may include additional terms to and/or vary this T&C at the Organiser’s sole discretion at any point of time and any additional and/or variation of the terms shall be incorporated by reference immediately at the point of time in which it is made available on the Organiser’s website. You are advised to visit the Organiser’s website from time to time to check on the latest T&C. In the event of any inconsistency between any terms and conditions stipulated in any of the Organiser’s marketing brochures, leaflets, buntings, or otherwise any other platforms and this T&C stipulated herein, this T&C shall prevail.

1.8.      Further to paragraph 1.7 above, CompAsia may also include additional terms to and/or vary the Trade-in Device T&C at CompAsia sole discretion at any point of time and any additional and/or variation of the terms shall be incorporated by reference immediately at the point of time in which it is made available on at CompAsia’ link provided above.

1.9.      All the Campaign T&C will be made available publicly before and/or during the Campaign Period.

2.      PARTICIPANT’S ELIGIBILITY

2.1   An eligible Participant in the Campaign must be a natural person over 18 years of age and having full legal capacity according to the Malaysia laws.

2.2     Where inaccurate or erroneous data are provided by the Participant, the Organizer reserves the right to reject or disqualify the Participant from the Campaign and so without giving any reasons or notice.

2.3     Each Participant is only limited to one Bonus redemption per week.

 

3. PROMOTION MECHANISM

Mechanism of the Campaign

3.1    This Campaign offers trade-in bonus up to MYR 500 for the purchase of selected Xiaomi products as set out below (“Bonus”). The Bonus shall be subject to these T&C.

3.2    To qualify for the Bonus, the Participants shall ensure all of the following:

3.2.1       To purchase at least one (1) unit of the selected Xiaomi product in any of participating Xiaomi Authoriszd Store during the abovesaid Campaign Period;

3.2.2       Participants trade-in Device must exceed a trade-in value of MYR 200; and

3.2.3       Participants must have obtained the Device by legal means and is not trading in lost or stolen device.

3.3   Please note that the trade-in Device is not limited to Xiaomi model only. For eligible models lists, please refer to clause 3.5 of this T&Cs, or you can walk-in to any of our participating Xiaomi Authoriszd Store.

3.4  The Bonus under the Campaign during the Campaign Period are applicable for the following selected Xiaomi products:

3.5           For avoidance of any doubt, CompAsia is not a subcontractor of the Organizer in anyway whatsoever, and therefore, the Organizer, shall not be liable for any faulty performance of CompAsia.

 

4        PERSONAL DATA

You agree to provide CompAsia with the following personal data: Customer NRIC number, Device IMEI and model. CompAsia will share some of your personal data, including the International Mobile Equipment Identity (IMEI) of your surrendered Device and new device you purchase, etc., to Xiaomi or allows Xiaomi to collect and process personal data on its own for the purposes of facilitating the trade-in in Malaysia, including but not limited to allowing Xiaomi to verify the trade-in orders and pay the Bonus.

CompAsia and the Organizer, as independent data controllers, will collect, use, and process the Participant’s personal data only for specified, explicit and legitimate purposes. In particular, ensure the proper organization and management of the Campaign.

 

By providing the personal data, Participant indicates that he/she have read, understood and agreed to be bound by Xiaomi’s Privacy Policy stated at https://www.mi.com/my/about/privacy and CompAsia’s privacy policy [ https://compasia.my/pages/privacy-policy]. The Participant agrees that Organiser and/or its agent and/or its third-party service providers may contact them by telephone, email or such other method in connection with this Campaign.

 

Participant agrees and provides consent to the Organiser and/or CompAsia to the use of any Personal Data as provided by the Participant for the purpose of participation in this Campaign in line with the Personal Data Protection Act 2010, to the extent that any personal data provided shall only be processed and be used by Organiser and/or CompAsia for lawful purpose directly related to the running of this Campaign including but not limited to the purposes of promotional events, advertising, marketing and any administrative matters to facilitate the management and organizing of this Campaign.

 

You shall be solely responsible for all data stored in your surrendered Device and you shall delete all data from the surrendered Device before it is surrendered to CompAsia or the Organiser for the trade-in and/or the Campaign.

 

 

5      LIABILITY AND REPRESENTATION

5.1 ORGANIZER’S REPRESENTATION

Unless otherwise expressly stated in this term, Organizer and its affiliated or third-parties provide the Campaign on best effort basis only and exclude all warranties and conditions of any kind whether expressly or implied. In particular but without limitation, Organizer and its affiliated or third-party Organizers do not warrant or represent that:

i.         The Campaign is fit for any purpose or meet Participant requirements or is provided without any errors or deficiencies or that the Campaign in compliance with any quality levels, as the case may be;

ii.        The Campaign is available to Participant at any time and provided to Participant without disruption, interruption or delay;

 

5.2 ORGANIZER’S LIABILITY

The Organizer and/or CompAsia is not liable to Participant, regardless of the legal grounds, in particular whether in contract, tort (including negligence) or any theory of liability, in or out of the connection with the participation in the Campaign for:

i.    Any indirect, incidental, special or consequential damages;

ii.  Any loss of income, business, actual or anticipated profits, opportunity, goodwill or reputation (whether direct or indirect);

iii. Any damage to and/or corruption or loss of data (whether direct or indirect);

iv.  Any changes, modifications, extensions or limitations (including any suspension of Participant) in the Campaign;

v.    Access to Participant account and account data or Participant registration data taking part of the Campaign, or any permanent or temporary cessation in the terms or conditions of the Campaign (or any part of them).

 

5.3  In the term that Organizer and/or CompAsia is liable for a breach of these terms, Organizer and/or CompAsia liability shall be limited to damages which Organizer and/or CompAsia must typically expect at the time of the conclusion of these Terms due to the circumstances known at the time. Notwithstanding the above, such damages shall not be higher than Ringit Malaysia One Hundred (RM100.00).

 

5.4 Nothing in these T&C shall exclude or limit Organizer and/or CompAsia:

a.       liability for death, personal injury or fraud or in accordance with any product liability act; and

b.       warranty or liability for damages or losses which may not be lawfully excluded or limited by applicable law.

5.5 If the laws in the Participant jurisdiction do not allow the exclusion of certain warranties, terms or conditions or the limitation or exclusion of liability for loss or damage caused by negligence, breach of contract or breach of implied terms, or incidental or consequential damages, only the limitations which are lawful in that jurisdiction will apply to the Participant and CompAsia’s or  Organizer’s liability and warranty will be limited to the maximum extent permitted by applicable law.

 

6. PARTICIPANT’S REPRESENTATION AND LIABILITY

6.1 Participant warrants and represents that the Participant is the legal owner of the old Device and possess the ownership and any right associated with the old Device during the process of the trade in with CompAsia and participation of the Campaign until the ownership, title and rights of the old Device is transferred to CompAsia in accordance with the terms and conditions of CompAsia.

6.2     The Participant shall not transfer, sell, hire or otherwise deal with the surrendered Device in a manner that is not consistent with the ownership rights of CompAsia.

6.3     The Participant agree and acknowledge that by sending the old Device to CompAsia, the Participant agree to release CompAsia from any claims, losses or damages that may arises with respect to the old Device.

6.4   Participant is entirely responsible for any breach of the obligations under:

a.       These T&C;

b.       any applicable law or regulation in the relevant jurisdictions, including the jurisdiction where you are a resident or from where you are participating in the Campaign.

c.       For the consequences of any such breach, including any loss or damage which Organizer or any third-party may incur or suffer. Organizer will have no responsibility to Participant or to any third party in respect of such breach.

 

7 OTHERS

7.1 Organiser reserves the right to change the T&C in case of:

a.       changes in applicable general provisions of law resulting in the need to adapt it to these changes in law;

b.       removing any errors and clarifying any ambiguities in the T&C;

c.       issuance of a judgment or other act by a court or authorized public authority resulting in the need to amend the T&C in order to adapt to such a judgment or other similar act;

d.       organisational or legal changes of the Organiser.

7.2 The modified T&C shall apply to the Participant who does not withdraw from participating in the Campaign from the implementation of the changes to the T&C.

7.3 Where any terms and conditions of this T&C is discovered to be invalid or void, that portion of the terms and conditions shall be severed from this T&C as to render the remainder of this T&C valid and enforceable to give effect to the spirit and intent of Campaign.

 

8. LEGISLATION AND APPLICABLE JURISDICTION

Participation in the Campaign will be governed by the laws of Malaysia and the parties submit to the exclusive jurisdiction of the courts of Malaysia.
