Terms and Conditions

1. XIAOMI TRADE-IN PROMOTION CAMPAIGN

1.1. The Trade-In Promotional Campaign (hereinafter referred to as the "Campaign") is organized by Xiaomi Technologies Malaysia Sdn Bhd (hereinafter referred to as the "Organizer" or "Xiaomi") and allows customers (hereinafter referred to as the "Participants") to trade in their old devices, including but not limited to smartphones and tablets (collectively referred to as the "Devices"). The Devices’ trade-in value will be assessed by Xiaomi’s authorized trade-in partner, CompAsia Sdn Bhd (hereinafter referred to as "CompAsia"), and Participants will receive an instant discount on the purchase price of new Xiaomi products under this Campaign (hereinafter referred to as the "Discount").

1.2. The trade-in process, including the assessment and valuation of Devices, shall be governed by the terms and conditions provided by CompAsia. These terms are accessible at the following link: https://my-caecom-microsite-portal.compasia.com/terms-and-conditions ("Trade-In Device T&C").

1.3. The Campaign period shall commence on 11th January 2025 at 18:00:00 (GMT+8) and end on 28th February 2025 at 23:59:59 (GMT+8) (hereinafter referred to as the "Campaign Period"). The Organizer reserves the right, at its sole discretion, to shorten, extend, or cancel the Campaign Period without prior notice.

1.4. This Campaign is exclusively applicable to the REDMI Note 14 Pro series. The trade-in service shall be provided solely by CompAsia, and the trade-in value of Devices shall be determined solely by CompAsia based on the condition and specifications of the traded-in Devices.

1.5. Participants agree to comply fully with these Terms and Conditions (hereinafter referred to as the "T&C"). These T&C are limited solely to the Organizer’s role in organizing this Campaign.

1.6. The Campaign operates on a first-come, first-served basis, subject to stock availability.

1.7. The Organizer reserves the right to amend these T&C or introduce additional terms at its sole discretion at any time. Such amendments shall take effect immediately upon publication on the Organizer’s official website. Participants are advised to regularly review the Organizer’s website for updates. In the event of any inconsistency between these T&C and any marketing materials, brochures, or other promotional content, these T&C shall prevail.

1.8. Separately, CompAsia may also amend the Trade-In Device T&C at its sole discretion. Any such amendments shall take effect immediately upon publication on the website link provided above.

1.9. These T&C will be publicly available during the Campaign Period.

2. PARTICIPANT’S ELIGIBILITY

2.1. To be eligible for the Campaign, Participants must:

·         Be natural persons aged 18 years or older, possessing full legal capacity under Malaysian law.

·         Provide accurate personal information as requested during the trade-in process.

2.2. Any inaccurate or erroneous data provided by the Participant may result in disqualification without notice or explanation.

2.3. Each Participant is limited to one (1) Bonus redemption per trade-in transaction.

2.4. Devices must:

·         Be in working condition and meet diagnostic criteria as set by CompAsia.

·         Not be lost or stolen property.

2.5. Participants trading in multiple Devices during a single transaction shall receive only one (1) Bonus, corresponding to the Device with the highest eligible top-up value.

3. CAMPAIGN MECHANISM

3.1. This Campaign provides a trade-in Bonus of up to MYR 300 for selected models, or a flat MYR 100 for all other eligible Devices, on the purchase of a REDMI Note 14 Pro series product.

3.2. To qualify for the Bonus:

·         Participants must purchase at least one (1) unit of the REDMI Note 14 Pro from a participating Xiaomi Authorized Store during the Campaign Period.

·         The trade-in Device must have a minimum trade-in value of MYR 50, as determined by CompAsia.

·         Participants must ensure that the Device is not obtained through unlawful means.

3.3. Trade-in Devices are not limited to Xiaomi models. Eligible models for Bonus calculations are listed in Appendix A or can be verified at participating Xiaomi Authorized Stores.

3.4. The Bonus applies exclusively to the following products under the REDMI Note 14 Pro series:

·         REDMI Note 14 Pro+ 5G

·         REDMI Note 14 Pro 5G

·         REDMI Note 14 Pro

3.5. Details of accepted trade-in Devices and their corresponding Bonus values are provided in Appendix A.

4. LUCKY SPIN WHEEL PROMOTION

4.1. Participants who trade in an eligible Device and purchase a REDMI Note 14 Pro are entitled to one (1) spin of the Lucky Spin Wheel per transaction.

4.2. The Lucky Spin Wheel offers prizes to every Participant. Prizes include:

·         Xiaomi products (e.g., Robot Vacuum, REDMI Pad SE, Air Purifier), and Trade-in value top-up vouchers as below table:

·         First come first served, while prizes last.

4.3. Prizes will be awarded as follows:

·         Xiaomi Products: Delivered to the Participant's registered address within 7 to 14 working days.

·         Trade-In Vouchers: Instantly applied to the trade-in transaction and reflected in the final discounted price.

4.4. Spin Wheel Journey:

·         Upon completing the trade-in and purchasing a REDMI Note 14 Pro, the Participant will be guided to access the LuckySpin Wheel site by Compasia.

·         The Participant will spin the digital wheel, and the prize outcome will be displayed instantly.

·         For Trade-in Vouchers, unique voucher shown on the site MUST be utilised before trade-in order completed.

·         For Xiaomi product prizes, the Participant must provide a valid delivery address.

4.5. The Organizer and CompAsia reserve the right to verify all prize claims.

5. ADDITIONAL TERMS & CONDITIONS

5.1. The Organizers reserve the right to modify, suspend, or cancel the Promotion without prior notice.

5.2. The Promotion is subject to stock availability of the REDMI Note 14 Pro and eligible prizes.

5.3. Any fraudulent activity, including tampering with the Lucky Spin Wheel, will result in immediate disqualification.

5.4. The decision of the Organizers is final and binding in all matters related to the Promotion.

6. PERSONAL DATA

6.1. By participating in the Campaign, Participants consent to the collection, use, and processing of personal data, including but not limited to NRIC numbers and IMEI numbers, by CompAsia and Xiaomi.

6.2. Such data will be used solely for purposes related to the Campaign, including verification of trade-in transactions and delivery of applicable Bonuses.

6.3. Participants agree to delete all personal data stored on the surrendered Device before handing it over to CompAsia.  Participants shall be solely responsible for all data stored in their surrendered Device and CompAsia or the Organiser shall not be held liable or responsible for any loss of data after the Device has been surrendered.

6.4. Both the Organizer and CompAsia act as independent data controllers and shall process all personal data in compliance with Malaysian privacy laws and their respective privacy policies:

7. LIABILITY AND REPRESENTATION

7.1 ORGANIZER’S REPRESENTATION

Unless otherwise expressly stated in this term, Organizer and its affiliated or third-parties provide the Campaign on best effort basis only and exclude all warranties and conditions of any kind whether expressly or implied. In particular but without limitation, Organizer and its affiliated or third-party Organizers do not warrant or represent that:

(i)                  The Campaign is fit for any purpose or meet Participant requirements or is provided without any errors or deficiencies or that the Campaign in compliance with any quality levels, as the case may be; and

(ii)                The Campaign is available to Participant at any time and provided to Participant without disruption, interruption or delay.

7.2 ORGANIZER’S LIABILITY

The Organizer and/or CompAsia is not liable to Participant, regardless of the legal grounds, in particular whether in contract, tort (including negligence) or any theory of liability, in or out of the connection with the participation in the Campaign for:

(i)                  Any indirect, incidental, special or consequential damages;

(ii)                Any loss of income, business, actual or anticipated profits, opportunity, goodwill or reputation (whether direct or indirect);

(iii)               Any damage to and/or corruption or loss of data (whether direct or indirect);

(iv)               Any changes, modifications, extensions or limitations (including any suspension of Participant) in the Campaign; and

(v)                 Access to Participant account and account data or Participant registration data taking part of the Campaign, or any permanent or temporary cessation in the terms or conditions of the Campaign (or any part of them).

7.3  In the term that Organizer and/or CompAsia is liable for a breach of these terms, Organizer and/or CompAsia liability shall be limited to damages which Organizer and/or CompAsia must typically expect at the time of the conclusion of these Terms due to the circumstances known at the time. Notwithstanding the above, such damages shall not be higher than Ringgit Malaysia One Hundred (RM100.00).

7.4 Nothing in these T&C shall exclude or limit Organizer and/or CompAsia:

(i) liability for death, personal injury or fraud or in accordance with any product liability act; and

(ii) warranty or liability for damages or losses which may not be lawfully excluded or limited by applicable law.

7.5 If the laws in the Participant jurisdiction do not allow the exclusion of certain warranties, terms or conditions or the limitation or exclusion of liability for loss or damage caused by negligence, breach of contract or breach of implied terms, or incidental or consequential damages, only the limitations which are lawful in that jurisdiction will apply to the Participant and CompAsia’s or Organizer’s liability and warranty will be limited to the maximum extent permitted by applicable law.

8. PARTICIPANT’S REPRESENTATION AND LIABILITY

8.1 Participant warrants and represents that the Participant is the legal owner of the old Device and possess the ownership and any right associated with the old Device during the process of the trade in with CompAsia and participation of the Campaign until the ownership, title and rights of the old Device is transferred to CompAsia in accordance with the terms and conditions of CompAsia.

8.2         The Participant shall not transfer, sell, hire or otherwise deal with the surrendered Device in a manner that is not consistent with the ownership rights of CompAsia.

8.3         The Participant agree and acknowledge that by sending the old Device to CompAsia, the Participant agree to release CompAsia from any claims, losses or damages that may arises with respect to the old Device.

8.4   Participant is entirely responsible for any breach of the obligations under:

(i) These T&C; and

(ii) Any applicable law or regulation in the relevant jurisdictions, including the jurisdiction where you are a resident or from where you are participating in the Campaign.

For the consequences of any such breach, including any loss or damage which Organizer or any third-party may incur or suffer. Organizer will have no responsibility to Participant or to any third party in respect of such breach.

9 OTHERS

9.1 Organiser reserves the right to change the T&C in case of:

(i) changes in applicable general provisions of law resulting in the need to adapt it to these changes in law;

(ii) removing any errors and clarifying any ambiguities in the T&C;

(iii)               issuance of a judgment or other act by a court or authorized public authority resulting in the need to amend the T&C in order to adapt to such a judgment or other similar act; or

(iv) organisational or legal changes of the Organiser.

9.2 The modified T&C shall apply to the Participant who does not withdraw from participating in the Campaign from the implementation of the changes to the T&C.

9.3 Where any terms and conditions of this T&C is discovered to be invalid or void, that portion of the terms and conditions shall be severed from this T&C as to render the remainder of this T&C valid and enforceable to give effect to the spirit and intent of Campaign.

10. LEGISLATION AND APPLICABLE JURISDICTION

Participation in the Campaign will be governed by the laws of Malaysia and the parties submit to the exclusive jurisdiction of the courts of Malaysia.
