TERMS AND CONDITIONS
1. Activity organisation and organiser
The following terms and conditions (hereinafter, the "Terms") regulate the rules for participating the activity called “MI.COM BIRTHDAY EXCLUSIVE COUPON BENEFIT” (hereinafter, the "Activity") which is organized by:
Xiaomi Technologies Malaysia Sdn Bhd (Company No. 202101002126 (1402424-W)) ("Organiser") to reward loyal eligible individuals (("Participant(s)") the opportunity to receive birthday exclusive coupons.
2. Start date
The Activity shall commence at 10:00 am on 1st June 2024 (hereinafter, the ”Start Date”) and will continue until they are superseded by newer versions of the Terms.
3. Territory
This Activity is open to all individuals who are residents in Malaysia (Hereinafter, the “Territory”).
4. Participant's eligibility
1. The birthday exclusive coupons are only for the registered users of mi.com/my (Hereinafter, the “Participant(s)” or “You”).
2. To receive the birthday exclusive coupons on mi.com, complete the registration process on mi.com/my and provide your birthday details in your mi.com account.
3. You have the option to choose whether or not to provide your birthday information in your mi.com account. However, please note that if you opt not to provide this information, we will be unable to send you the birthday exclusive coupon.
4. Please ensure the accuracy of your birthday information before submission on mi.com/my, as once submitted, it may not be easily modified by you.
5. The path to fill in your birthday information is as follows:

6. In order to participate in the Activity, you must have the legal age of the Territory and have the legal capacity according to the applicable law of your place of residence.
5. Description and using rules about the Birthday exclusive coupon
1. The birthday exclusive coupon is a 10% discount coupon and can be used to purchase any product on mi.com/my.
2. The birthday exclusive coupon requires a minimum purchase amount on RM200 (in the same order, cannot be used along with any other coupon as designated by Xiaomi from time to time). Please note that the 10% discount applies to the product price only(shipping fees are not eligible for this birthday exclusive coupon).
3. The birthday exclusive coupon will only be issued once per person per calendar year. The said coupon shall be valid during your birthday month and shall be sent to you on the first day of the month during your birthday month.
4. If a user's birthday falls within the current month and they provide their birthday information during that month (including on the 1st of the month), the birthday exclusive coupon will not be sent until the following month.
[Example]:
• If User A's birthday is 6th, April, the coupon will be sent to User A's account on 1st, April, and the said coupon shall be valid from 1st. April to 30th. April.
• If User A's birthday is 6th, April and User A only provides his/her birthday information on or after 1st April, User A will not receive a birthday exclusive coupon for that month but shall be eligible in the following year; if User A provide his/her birthday information on 31st March, User A will receive a birthday exclusive coupon on 1st April.
5. Please be aware that the birthday exclusive coupon cannot be combined with other coupons and is valid for a single use only. For instance, if the coupon is used for a purchase and the product is subsequently returned, the coupon becomes void, and only the actual amount paid will be refunded. The coupon is non-transferable, personal, and cannot be exchanged for cash equivalents.
6. You can also review the relevant information and usage rules of the coupon in the coupon center.

7. You have the discretion to decide whether to use the birthday exclusive coupon.
6. Issuance notice of the Birthday exclusive coupon
1. Kindly be informed that once the birthday exclusive coupon is issued to your mi.com account, you will receive a notification via the Mi Store App push message.
2. In order to receive the notification, please make sure that the latest version of the Mi Store App has been installed on your mobile phone and the push message notification reminder has not been turned off. In case push notification are disabled, you can still find the coupon in your Mi Account at the end of the month prior to the month of your birthday. The path to find the coupon is as follows:

8. Acceptance of the Activity's Terms
By participating in the Activity, you are hereby accepting (i) the present Terms as well as (ii) Xiaomi’s Terms of Use and Privacy Policy of mi.com/my, which can be accessed and reviewed on mi.com/my websites.
9. Personal data
1. We take your privacy very seriously, and we are committed to keeping your personal information well safe and secure. We undertake to protect your personal information in accordance with all our privacy policies and the applicable laws.
2. By providing the personal data, Participant indicates that he/she have read, understood and agreed to be bound by the Privacy Policy stated at https://www.mi.com/my/about/privacy. The Participant agrees that Organiser and/or Xiaomi and/or its agent and/or its third-party service providers may contact them by telephone, email or such other method in connection with this Activity.
3. Participant agrees and provides consent to the Organiser and/or Xiaomi to the use of any Personal Data as provided by the Participant for the purpose of participation in this Activity in line with the Personal Data Protection Act 2010, to the extent that any personal data provided shall only be processed and be used by Organiser and/or Xiaomi for lawful purpose directly related to the running of this Activity including but not limited to the purposes of promotional events, advertising, marketing and any administrative matters to facilitate the management and organizing of this Activity.
4. When you decide to participate in this Activity, it means that you agree to provide your personal information to us and accept the present Terms and our Privacy Policy.
4. Your birthday information will only be used to issue the birthday exclusive coupons to you. We will carefully protect your birthday information and it will not be used for any other purposes. Your birthday information will be kept for the time necessary to guarantee you with the exercise of your rights and actions in relation to the Activity.
5. If you have any concerns about our data processing practice, please contact us at https://privacy.mi.com/support/?locale=en to submit your concerns. We will be happy to hear from you.
10. Miscellaneous
1. The present Terms will be published on www.mi.com/my and in any other way it deems appropriate to inform you.
2. We will interpret and explain the Terms of this Activity in accordance with Malaysian law and the parties submit to the exclusive jurisdiction of the courts of Malaysia.
3. You acknowledge that the general terms and conditions on mi.com/my still apply. In the event of any conflict between the present Terms and the general terms described on mi.com/my, the present Terms shall prevail.
4. In the event any coupons or gift are being awarded to the Participant having provided false or mistaken identity or information, Organiser shall have the right to revoke the Participant’s eligibility for the said coupons or gift.
5. Recipients of coupons shall not substitute any coupons or exchange the said coupons for money. Organiser reserves all rights in its sole discretion to substitute any coupons with one of equal or greater value. Organiser is responsible only for the delivery of the coupons and is not responsible for the condition, quality and fitness of the said coupons. Any imposition of taxes, fees, and any other costs associated with the acceptance and use of the coupons are the sole responsibility of the recipients.
6. Participants shall accept the coupons under this Activity as they are. Organiser makes no representation, warranty or undertaking as to any implied terms and conditions with respect to the coupons under this Activity. Organiser assumes no liability or responsibility in respect to defect or deficiency of the coupons or the nature/consumption of the coupons and will not entertain any direct correspondence with anyone in this regard.
7. Organiser shall not be responsible for any losses or damages directly or indirectly incurred by any party including the Participant in connection or arising from acts or omissions or in any way related to this Activity or to the nature/consumption of the coupons.
8. The Participant agrees to discharge and release Organiser and/or Xiaomi from any liabilities and claims (including from breach of contract, tort, negligence or any other cause of actions at law or equity) arising out of or in any way connected to this Activity or to the Participant’s entry in this Activity or to the nature/consumption of the coupons.
9. The Participant further agrees to discharge and release any third party which is related to and connected with this Activity from any liabilities and claims (including from breach of contract, tort, negligence or any other cause of actions at law or equity) arising out of or in any way connected to this Activity or to the Participant’s entry in this Activity or to the nature/consumption of the coupons.
10. By entering into this Activity, the Participant agrees to indemnify and hold Organiser and/or Xiaomi, their group of companies, their officers, directors, shareholders, predecessors, successors in title, employees, agents and representatives harmless from any claims, losses, damages, liability, claims or expenses (including any legal fees), suffered or incurred by Organiser and/or Xiaomi due to or in any way arising from this Activity.
11. If Participants are discovered to be using or have used improper means to participate in this Activity, Organiser reserves the right to cancel the eligibility without notice including without hesitation, the commencement of legal proceedings under full extent of applicable laws.
12. Organiser reserves the rights to modify and/or cancel any of the stated Terms at any time without notice. Participants are encouraged to check from time to time to view any amendments and/or changes made to the stated Terms.
