YouTube Premium Membership Offer Terms
For the purpose of these Terms, wherever the context so requires, “you” or “user” shall mean any natural or legal person who has agreed to participate in this Contest. The term “Xiaomi”, “we”, “us”, “our” shall mean Xiaomi and its affiliates.
The Offer
This YouTube Premium membership offer (“Offer Membership”) provides you with subscription benefits at no charge, as a trial for a period of 3 months from the day you redeem the Offer (the “Offer Duration”). The terms and conditions available at www.youtube.com/premium/restrictions shall apply to your subscription during the Offer Duration.
Duration
Offer Term: 12th June, 2024 at 0:00 a.m. to 31st August, 2024 at 23:59:59pm (“Offer Term”).
Offer Membership expires and must be redeemed by 31st August, 2024 at 23:59:59 pm.
Requirements and eligibility
The Offer Membership requires qualifying form of payment at sign-up and requires a Google account. This Offer Membership is limited to available to users who are not current YouTube Premium or YouTube Music Premium subscribers, and have not been YouTube Premium, YouTube Music Premium, YouTube Red, or Google Play Music subscribers nor participated in a YouTube Premium, YouTube Music Premium, Google Play Music, or YouTube Red trial before and who purchased and activated the following device(s) in India: Xiaomi 14, Xiaomi 14 Ultra, Xiaomi 14 Civi (“Eligible Devices”) during the Offer Term. Offer Membership must be redeemed by 31st August, 2024 at 11:59 pm. Offer Membership may not be combined with any other promotion, discount, code, and/or offer. Promotional value of offer and shall be non - transferable, not for resale, and not redeemable for cash or cash equivalent. You must be 18 years or older. You need a valid form of payment required at sign-up but you will not be charged until the trial period expires.
Recurring billing and cancellations
On the date that your Offer Period ends, your subscription will begin and your form of payment will be automatically charged at the standard individual subscription price, currently ₹129 on a monthly recurring basis until you've cancelled your subscription. You can cancel anytime. No refunds for partial billing periods are available. To avoid being charged, you must cancel before the end of the Offer Period. If you cancel your subscription during the Offer Period, your membership will remain active until the end of the Offer Period.

Indemnity and Liability
You hereby agree to indemnify and hold Xiaomi and its associated companies harmless against any and all loss, claim, demands, costs, damages, judgments, expenses or liability (including legal costs) including third party claims of whatsoever nature at all time arising out of and in connection with including but not limited to (i) any claims of infringement of any third party intellectual property rights (ii) any act or omission; (iii) any misrepresentation, misconduct, fraud by you informed/expressed by you (iv) any breach of applicable laws and (v) any breach of these Terms.
UNDER NO CIRCUMSTANCES, WILL XIAOMI OR ANY OF ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR CONTRACTORS SHALL BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY LOSSES OR DAMAGES ARISING FROM THE CONTEST, UNDER TORT, COMMON LAW OR UNDER PUBLIC POLICY, EVEN IF SUCH PARTICIPANT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. To the maximum extent that is permissible under law, Xiaomi’s liability shall be limited to INR 1000 (Rupees One Thousand).
Other Terms and Conditions
You agree and acknowledge that your redeeming of this Offer Membership is voluntary. You redeeming this Offer Membership constitutes acceptance of these terms and conditions. By redeeming this Offer Membership, you agree to receive communication(s) from Xiaomi and/or its affiliates relating to the Offer and unconditionally agree not to make any claim or raise any complaint against Xiaomi and/or its officers, directors, employees, subsidiary or any authorized third-party agency in this respect.
Xiaomi reserves the right to alter, modify or cancel any terms herein, or modify, terminate or withdraw the Offer Membership at any time during the Offer Term at its sole discretion without prior notice or assigning any reason thereof.
You agree and understand that Xiaomi shall not be liable for any issues, claims, or disputes arising out of or in connection with Offer Membership, including but not limited to service quality, availability, or any other aspect of the Offer Membership.
There is no levy of any fee for redeeming this Offer Membership. Any person who claims to be from Xiaomi and asks you to pay any fee for redeeming this Offer Membership is defrauding you and you should report this to the local police or Xiaomi immediately. There are also no lotteries, prize monies, cash prizes etc. distributed by Xiaomi with regard to this Offer Membership. Any person who claims to be from Xiaomi and offers any lotteries, prize monies, cash prizes etc. to anyone is defrauding you and you should report this to the local police immediately.
Xiaomi or any of its affiliates will not be liable for any loss of earnings, employment or otherwise caused to you and arising as a result of you redeeming this Offer Membership.
This Offer shall be governed by the laws of India. All disputes with respect to this Offer shall be subject to the exclusive jurisdiction of the courts in Bengaluru, India.
Failure by Xiaomi to enforce any of its right at any stage does not constitute a waiver of those rights.
If any provision of these terms is held by any court or other competent authority to be void or unenforceable in whole or part, the other provisions of these terms and the remainder of the affected provisions shall continue to be valid.
XIAOMI DISCLAIMS ALL OTHER REPRESENTATIONS AND WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR USE, AND NON-INFRINGEMENT OF THIRD-PARTY INTELLECTUAL PROPERTY RIGHTS.
