Mi Points Program Terms and Conditions

These terms and conditions govern Xiaomi’s loyalty program (“the Program”) which offers customers who have a Mi Account (“Participants”) the opportunity to earn and redeem points (“Mi Points”).  “We”, “us”, “our” and “Xiaomi” means Xiaomi Technology Australia Pty Ltd (ABN 50 685 941 244)

We may update these terms and conditions from time to time and will post updated versions on our Website, provided that where any updates have more than a minor detrimental impact on Participants we will provide prior notice to Participants. We may introduce special or supplementary terms where we undertake a special promotion.

1. Eligibility

(a) The Program is open to Participants who are residents of Australia who are natural persons and have an active Mi Account. If you are under the age of 18, you need the consent of your parent or guardian to be a Participant.

(b) We are under no obligation to accept any particular person as a Participant, and may refuse to allow any person to be a Participant. We will use reasonable efforts to notify you where it refuses your participation in the Program.

2. What are Mi Points?

(a) “Mi Points” are points that Participants collect by making purchases using their Mi Account or undertaking any of the activities set out in section 3 of these terms and conditions.

(b) Mi Points can be used to:

i. claim offers that may be published on our Website or the Mi Store; or

ii. purchase discount coupons for use toward purchases of products and/or services on our Website or the Mi Store.

(c) Mi Points are automatically credited to your Mi Account within 16 days.  

(d) You may check your Mi Points balance on your Mi Account via our Website or the Mi Store under “Available Mi Points”. We may send you notifications from time to time about your Mi Points balance to the email address you provide to us. 

3. How do I earn Mi Points?

(a) Participants can earn Mi Points after successfully registering a Mi Account and as set out below. You must be logged in to your Mi Account on our Website or the Mi Store (as applicable) when undertaking the below activities to earn Mi Points. If you are not logged in to your Mi Account, you will not earn Mi Points.

(b) Purchases. You can earn Mi Points for each purchase made on the Website or Mi Store. Mi Points are automatically credited to your Mi Account for purchases made when you are logged into your Mi Account. You receive 1 Mi Point for each 1 AUD of purchases, so that, for example, for a AUD100 purchase you receive 100 Mi Points. Mi Points are not earned on postage or handling charges. We may from time to time run promotions or offers where you receive additional Mi Points, subject to the applicable terms and conditions of those promotions or offers.

(c) Enrolling. You can earn Mi Points once for registering your Mi Account and for downloading the Mi Store app, as follows:

i. Registering a Mi Account = 100 Mi Points

ii. Downloading the Mi Store app and logging into your Mi Account on the Mi Store = 200 Mi Points

(d) Sharing content. You can earn 10 Mi Points for sharing links to our Website or the Mi Store on your social media account, up to a maximum of 3 times (i.e., 30 Mi Points) per calendar month. You must use the “share” button on our Website or the Mi Store and follow the instructions provided to earn Mi Points for sharing content. It is your responsibility to ensure that you comply with the terms and conditions of your relevant social media account when sharing our content.

(e) Product reviews. You can earn Mi Points on your first review on a product that is published by us on our Website or the Mi Store. The following Mi Points may be earned per published product review, noting you may only submit one review per product:

i. Review with text only = 10 Mi Points

ii. Review with text and at least 1 related image = 20 Mi Points

iii. Review with text, image and a video = 30 Mi Points

Only reviews for products bought via our Website or the Mi Store are eligible to earn Mi Points. You will earn points for both positive and negative reviews, however, you must ensure the review complies with any terms and conditions of the review section of our Website or the Mi Store prior to submitting the review for publication.  In particular, we may delete or reject reviews which are offensive, obscene, vulgar, hateful, or are reasonably likely to infringe any third party’s rights. If we delete or reject a review for any of these reasons, we may also withdraw the earned Mi Points.

(f) Collect Fuels. There are interactive buttons called “Fuels” within the Mi Store. You can earn up to 10 Mi Points per day by clicking on the “Fuel” button in the Mi Store. If you click on the “Fuel” button for 7 consecutive days you will earn an additional 50 Mi Points, noting that the count of consecutive days resets once you earn the additional 50 Mi Points.

(g) Browse pages. You can earn up to 5 Mi Points by browsing certain webpages on the Website or the Mi Store for at least 15 seconds up to 5 times per calendar month, as such webpages are specified by us from time to time. We will provide details of eligible webpages to registered holders of Mi Accounts from time to time.

(h) Watch video. You can earn 50 Mi Points once by watching a video on the Website or the Mi Store as specified by us from time to time. We will provide details of eligible videos to registered holders of Mi Accounts from time to time.

(i) Other ways. You can earn Mi Points in other ways that we will notify you of from time to time. Where we run special promotions, there may be additional terms and conditions that apply in addition to these terms and conditions. We will notify you of any additional terms and conditions that may apply.

4. How to redeem Mi Points

(a) You must have the required amount of Mi Points to claim an offer or redeem a discount coupon. The amount of Mi Points required will be specified on our Website or the Mi Store.

(b) The availability of offers and discount coupons is limited and may vary from time to time.

(c) Discount coupons are subject to additional terms and conditions as specified on the coupon. They may be limited to certain product categories or minimum purchase prices and must be used within the timeframe specified on the coupon. Without limiting these additional terms and condition or requirements for use of discount coupons, any redeemed discount coupon is subject toi the following limitations:

i. a coupon does not apply to, and cannot be used to discount, shipping fees on an order;

ii. a coupon cannot be used in combination with any other rewards, benefits, offers, vouchers or coupons. Only one coupon may be used on any transaction; and

iii. coupons are non-transferrable and cannot be exchanged for cash.

5. Expiration of Mi Points

(a) You have 12 months to use Mi Points from the date on which you earn those Mi Points, after which the Mi Points will expire on the first day of the next calendar month and be removed from your Mi Account.  For example, Mi Points earned in January 2024 will expire on 1 February 2025.

(b) We send a notification on the first day of each calendar month notifying you of any Mi Points which have expired.

6. Your responsibilities and restrictions

(a) You must comply with these terms and conditions and any other additional terms and conditions in relation to the earning or redemption of Mi Points that we may notify you of from time to time.

(b) You agree and acknowledge that you must not:

i. transfer Mi Points and/or your Mi Account to any third party;

ii. sell (whether direct or indirect), exchange, use in an unauthorised manner or offer (for auction) any Mi Points; or

iii. use multiple Mi Accounts to accrue Mi Points.

(c) Mi Points cannot be exchanged, refunded or redeemed as cash.

7. Termination of Mi Point

(a) You may terminate your participation in the Program at any time by terminating your Mi Account.

(b) We may terminate or suspend your participation in the Program or withhold or remove Mi Points from your Mi Account where you:

i. breach these terms and conditions;

ii. engage in unacceptable conduct including misuse of Mi Points;

iii. where you have not earned any Mi Points or used your Mi Account at any time during a continuous 18 month period.

(c) We may withhold or remove the corresponding earned Mi Points from your Mi Account where you:

i. return a purchased product due to a change of mind; or

ii. remove or delete content shared on social media or any product reviews.

(d) We will use reasonable efforts to notify you where we terminate or suspend your participation in the program or withhold or remove Mi Points from your Mi Account but we may not always be able to do so.

(e) Where your participation in the Program is terminated by you under paragraph (a) above, your Mi Points and any offers or discount coupons that have been redeemed with Mi Points shall remain valid until your Mi Account is closed, or the Mi Points expire (whichever occurs first).

(f) Where your participation in the Program is terminated or suspended by us, your Mi Points and any offers or discount coupons that have been redeemed with Mi Points shall expire on the date of the termination or suspension.

8. Modifications to the Program

(a) We reserve the right to at any time withdraw, cancel, modify, change or make additions to the Program or Mi Points.

(b) We will use our best efforts to provide you with at least 30 days’ notice of any such changes to the Program or Mi Points, but we may not always be able to do so.

(c) If you do not agree with any changes or modifications to the Program or Mi Points, then please cease participating in the Program.

9. Liability

(a) We excluded and disclaim to the maximum extent permitted by applicable law all guarantees, warranties, representations, statements or terms of any kind, whether express or implied or imposed by law, relating to the Program.

(b) To the maximum extent permitted by applicable law, our maximum liability for all claims under or relating to the Program is limited to reinstating any Mi Points that may be in dispute.

(c) Nothing in these terms and conditions excludes, restricts or modifies any guarantee, term, condition, warranty, right or remedy implied or imposed by any applicable law or regulation (including the Australian Consumer Law) which cannot lawfully be excluded, limited or modified.

(d) Our liability to you is reduced to the extent that your acts or omissions (or those of a third party) contribute to or cause the loss or liability.

10. Privacy

We collect and handle any personal information you provide to us in relation to the Program in accordance with our Privacy Policy [https://www.mi.com/au/support/policy/privacy-policy].

12. General

(a) These terms and conditions are governed by the laws of New South Wales, Australia, and each party irrevocably submits to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.

(b) If any provision of these terms is found to be invalid or unenforceable, it will not affect the validity of the remaining provisions of these terms and conditions, which will remain in full force and effect.

(c) The term “including” when used in these terms and conditions is not a term of limitation.
