#SHOWLOVECHALLENGE TERMS AND CONDITIONS

1. CHALLENGE ORGANIZATION AND ORGANISER

The following terms and conditions (hereinafter, the "Terms") regulate the conditions for participation in the challenge called "#ShowLoveChallenge" (the "Challenge"), organized:

The Challenge will be accessible on the challenge page through the following websites:

Participants can also access the Challenge Page through Android Mi store App, the Mi Store App can be downloaded by clicking on the following Link: //play.google.com/store/apps/details?id=com.mi.global.shop.

The Organiser reserves the right to amend all or part of the Terms for technical, operational or commercial reasons, in which case the Organiser will publish this amendment together with the Terms in its own channels and media platforms.

2. TERRITORY

The Challenge is valid only in Spain, France and United Kingdom and on their respective local mi.com websites.

3. PARTICIPANT’S ELIGIBILITY

In order to participate in the Challenge, the participant must be at least 18 years of age. The participant must have a registered Mi account in the mi.com of their country of residence: https://www.mi.com/es/index.html (for Spain); https://www.mi.com/fr/index.html (for France) and https://www.mi.com/uk/index.html (for the United Kingdom), and download the Android Mi Store Application.

The participant shall be in possession of an Android mobile phone to participate in the Challenge and install or update to the 3.9.3 or above version of Mi Store APP; (hereinafter, the “Participant”). Participation is voluntary and free of charge (with the exception of internet costs). Inaccurate or erroneous data will not be accepted in the Challenge.

Participant must be able to demonstrate, at the request of the Organiser, and within a reasonable period, that they meet the necessary conditions to participate in the Challenge before they participate and/or at any time during the duration of the Challenge. Otherwise, the Organiser may disqualify the Participant at any time during or after the Term.

Employees of the Organiser or any company related to the Challenge and/or their family members up to the second degree may not participate in the Challenge.

The Challenge term is set as follows;

5.1 General Provisions of the Challenge

“#ShowLoveChallenge” is a Valentine’s day & love related themed challenge.

The Challenge will be accessible through the following Link:

and https://event.mi.com/fr/challenge2020/valentine (for France).

Participants will have the opportunity to participate in a “Discount Coupon Giveaway” as described in section 5.3 and in the “Most liked Photo Challenge” as described in section 5.4 Under the present Terms, Participants will have the opportunity to win different Prizes consisting in discount coupons as described herein.

5.2 The Challenge requirements

Participants are invited to submit on the Challenge Page a photo in relation to the Challenge’s Valentine’s day & love theme.

To be eligible, the Participant’s photograph shall meet the following requirements:

The Organizer reserves the right to review the Participant submissions and reject at its sole discretion any photos uploaded which does not fulfill the above requirements and so without any notice.

5.4. Discount Coupon Giveaway

Discount coupons can be obtained as follows:

i. Participants who successfully uploaded an Eligible Photo during the Submission Period and whose photo has not been rejected by the Organiser after submission; will automatically receive in their personal Mi Account one (1) discount coupon as described in section 6.1.

ii. Participants whose photos get at least ten (10) likes from other Participants during the Like Period, shall receive one (1) discount coupon as set out in section 6.2.

5.5 The Most Liked Photos Challenge

All the Eligible Photo successfully uploaded and verified by the Organizer will be published on the Challenge Page. Logged in Participants will be able to like the other Participants photos through their respective local mi.com (https://event.mi.com/es/challenge2020/valentine for Spain; https://event.mi.com/fr/challenge2020/valentine for France and https://event.mi.com/uk/challenge2020/valentine for the United Kingdom), the Mi Store app and the mobile web link (https://www.mi.com/es/index.html for Spain; https://www.mi.com/fr/index.html for France and https://www.mi.com/uk/index.html for the United Kingdom).

6. PRIZES

The Prizes shall consist of discount coupons of three (3) different values, described as follows:

6.1 Discount Coupon Giveaway

During the Submission Period, all Participant who successfully uploaded their Eligible Photo on the Challenge Page will automatically receive in their Mi account;
• a five-pound (£5) discount coupon with a minimum purchase of twenty pounds (£20) for Participants residing in the United Kingdom;
• a five-euro (5€) discount coupon with a minimum purchase of twenty euros (20€) for Participants residing in Spain and France.

During the Like Period, the Participants who obtained at least ten (10) likes from Participants; notwithstanding territories, will automatically receive from the Organizer:
• a twenty-pound (£20) discount coupon with a minimum purchase of one hundred pounds (£100) for Participants residing in the United Kingdom;
• a twenty-euro (20€) discount coupon with a minimum purchase of one hundred euros (100€) for Participants residing in Spain and France.

The discount coupon will be automatically sent within 48 hours in the Participant’s respective Mi Account. The Participants will be notified by the Organizer through a pop-out window in the Challenge Page. The discount coupon can be redeemed on all products available on the Participant’s local mi.com.

The discount coupon will be valid for fifteen (15) days after issue.

Discount coupons cannot be exchanged for any other gift or exchanged for its equivalent in cash. The discount coupons are personal and non-transferable.

6.2. The Most liked Photo Challenge

There will be a total of three (3) Winners, one (1) Winner per territory (Spain; France and the United Kingdom). Winners will be selected from other Participants based on the number of likes received on their photos.

The Participants whose photos received the highest number of like in their respective territory during the Like Period from Participants of different territories, shall be respectively designated as the Winner.

The Winner’s nickname and photo shall be published by the Organiser on Friday 21st February 2020 on the Challenge Page.

Five (5) days after the publication of the Winner on the Challenge Page, the Winner shall automatically receive in her/his Mi account as follows:

The Organizer will contact the Winner via email in order to receive the Prize.

The Winner will only be able to redeem one (1) coupon per eligible product at a time. Therefore, the Winner shall make two (2) separate purchase order in order to receive the two (2) Xiaomi mobile phones (Xiaomi Redmi Note 8T for Spain and the United Kingdom and Xiaomi Mi A2 for France). When making the purchase order, the Winner shall redeem the discount coupon by selecting the discount coupon, which will be displayed on the shopping chart.

The discount coupons received for the Most Liked Photo Challenge, are only valid for fifteen (15) days. The validity period shall start from the day that the discount coupons are received by the Winner on her/his Mi Account. Please be aware that if the Winner does not use the discount coupons during the validity period, the coupon will be void automatically.

The discount coupons cannot be exchanged for any other gift or exchanged for its equivalent in cash. The discount coupons are personal and non-transferable.

7. DELIVERY

The redeemed Prizes as set out in section 6.2, shall be delivered to the Winner(s) free of charge.

Free shipping applies for all the orders over 69 euros (for Spain and France) and 69 pounds (for the UK). For orders of lower value, shipping costs will be charged.

8. INTELLECTUAL PROPERTY AND IMAGE RIGHTS

By participating in the Challenge, Participant authorizes the Organiser to reproduce and make available to the public directly or through its web and/or its social networks, the nickname and image of the Winner, always in connection with the Challenge and/or for promotional or advertising purposes related to the Challenge. Such authorization must comprehend the use and exploitation of such Photos and images according to the present Terms.

The afore-mentioned authorization is granted for free and shall not entitle the Participant to any consideration whatsoever.

9. PERSONAL DATA

Participant in the Challenge agree to provide the Organiser with the collection of the following personal data: name and surname, postal address for the sole purpose of organizing the Challenge and distributing the prize.

Personal data will be kept for the time necessary to guarantee the Participant the exercise of their rights and actions in relation to the Challenge. Ultimately, we want the best for all our users. If you have any concerns about our data management practice outlined in our privacy policy please contact privacy@xiaomi.com to submit your concerns. We will be happy to resolve your concerns directly.

10. ACCEPTANCE OF THE RULES OF THE CHALLENGE

By participating in the Challenge, you are expressly accepting:
(i) the Terms Challenge:

(iii) the privacy policy of the website of the Organiser:

The Organiser shall not be liable for the Participant's infringements and/or infringements relating to this Challenge and the Organiser disclaims any liability for any loss suffered by the Participant in connection with the Prize and other aspects of the Challenge.

The Organiser is not responsible for any technical problems that may occur in the subsequent operation of the Prize, nor for the costs that may arise therefrom.

The Participant shall be entirely and exclusively responsible for the contents, messages and/or comments that he incorporates or communicates through the Challenge pages. In this sense, each Participant will be responsible in any case for any claim related, directly or indirectly, to the violation of the rights of image, data protection, honor, privacy and any other right owned by a third party that may have been violated by reason of the comments submitted to the Challenge, keeping the Organiser harmless from any liability arising from such violation.

The Organiser reserves the right to exclude from the Challenge, and therefore from the award of the Prize, any Participant who, in its opinion, has participated incorrectly or any Participant who defrauds, alters or disables the proper functioning and the normal and regulatory course of this Challenge, including those who are evidenced or suspected to have acted irregularly in the sense described.

11. LIABILITY AND REPRESENTATION

11.1. Organiser’s representation

Unless otherwise expressly stated in this term, Organiser and its affiliated or third-party Organisers provide the Challenge on best effort basis only and exclude all warranties and conditions of any kind whether expressly or implied. In particular but without limitation, Organiser and its affiliated or third-party Organisers do not warrant or represent that:

(i) The Challenge is fit for any purpose or meet Participant requirements or is provided without any errors or deficiencies or that the Challenge in compliance with any quality levels, as the case may be;

(ii) The Challenge is available to participant at any time and provided to Participant without disruption, interruption or delay;

(iii) Any information (whether oral or written) obtained by Participant from Organiser or as a result of Participant taking part in the Challenge (including any materials or products) will be suitable, accurate, complete, or reliable; and

(iv) That any deficiencies in the Challenge, including any defects in performance, operation or functionality of the Challenge will be fixed, corrected or otherwise remedied.

11.2 Organiser’s liability

Organiser is not liable to Participant, regardless of the legal grounds, in particular whether in contract, tort (including negligence) or any theory of liability, in or out of the connection with the participation in the Challenge for:

(i) Any indirect, incidental, special or consequential damages;

(ii) Any loss of income, business, actual or anticipated profits, opportunity, goodwill or reputation (whether direct or indirect);

(iii) Any damage to and/or corruption or loss of data (whether direct or indirect);

(iv) Any changes, modifications, extensions or limitations (including any suspension of Participant) in the Challenge.

(v) Access to Participant account and account data or Participant registration data) taking part of the Challenge, or any permanent or temporary cessation in the terms or conditions of the Challenge (or any part of them).

In the term that Organiser is liable for a breach of these terms, Organiser liability shall be limited to damages which Organiser must typically expect at the time of the conclusion of this terms due to the circumstances known at the time. Notwithstanding the above, such damages shall not be higher than 100 euros (or equivalent local currency).

Nothing in these terms shall exclude or limit Organiser:
a) Liability for death, personal injury or fraud or in accordance with any product liability act; and
b) Warranty or liability for damages or losses which may not be lawfully excluded or limited by applicable law. If the laws in the Participant jurisdiction do not allow the exclusion of certain warranties, terms or conditions or the limitation or exclusion of liability for loss or damage caused by negligence, breach of contract or breach of implied terms, or incidental or consequential damages, only the limitations which are lawful in that jurisdiction will apply to the Participant and Organiser’s liability and warranty will be limited to the maximum extent permitted by applicable law.

11.3. Participant liability

Participant is entirely responsible for any breach of the obligations under

(i) These Terms; and
(ii) Any applicable law or regulation in the relevant jurisdictions, including the jurisdiction where you are a resident or from where you are participating in the Challenge.
(iii) And for the consequences of any such breach, including any loss or damage which Organiser or any third-party may incur or suffer. Organiser will have no responsibility to Participant or to any third party in respect of such breach.

12. LEGISLATION AND APPLICABLE JURISDICTION

Participation in the Challenge will be governed by the Terms, which will be interpreted and applied in accordance with:
