These terms and conditions govern your use of our website located at https://www.mi.com/au/ (“the Website”), and apply to the sales of our products and services made available on the Website and the Mi Store. 

In these terms and conditions, “we”, “us”, “our” and “Xiaomi” means Xiaomi Technology Australia Pty Ltd (ABN 50 685 941 244).

Please read these terms and conditions carefully before using the Website, or placing any orders.  If you do not agree to these terms, please do not use the Website.

These terms and conditions apply to purchasers by consumers only.

We may update these terms and conditions from time to time, and will posted updated versions of the terms and conditions on our Website.

1. Purchases and orders

(a) To place orders via our Website or the Mi Store, you must sign-up to our Website or the Mi Store and hold an account (a “Mi Account”) and correctly provide the required information for purchase.

(b) By submitting an order to us and purchasing products via our Website or the Mi Store, an agreement exists between you and us once we accept an order.

(c) When you place an order to purchase products or services via the Website or the Mi Store, you are making an offer to purchase those products or services from us. Your order is accepted once we issue an email acknowledgement confirming your order and once payment has been received via our payments provider. Each accepted order is a separate agreement, and relates only to those products and/or services specified in the email acknowledgement of your order and for which availability has been confirmed.

(d) All orders placed via our Website and the Mi Store, are subject to our acceptance of your order and the availability of products and/or services. We reserve the right to accept or reject your order for any reason, including if we are unable to obtain authorisation for payment, the product is out of stock or has been withdrawn, or there is an error in the price, image or the product description.

(e) If a product becomes unavailable for any reason after an order is accepted, we may cancel the order and provide you with a full refund.

(f) If we do not accept your order, then we may return any discount coupons (subject to their terms and conditions) or Mi Points to your Mi Account. Please note that if your order is cancelled or not accepted, any shipping codes used will no longer be valid and cannot be used again.

2. Products, payment and prices

(a) The price, quantity and availability of products and services may change at any time without prior notice.

(b) All prices for products and/or services are quoted in the currency displayed on the Website or Mi Store and include all duties, fees and any other mandatory statutory charges, including GST (if applicable).

(c) Any delivery costs are separate to the price of the products and/or services and are calculated during the ordering process. Delivery methods will depend on the products ordered. The final price payable includes any delivery and administrative costs.

(d) You agree to pay the purchase price specified on the Website or Mi Store at the time that you place your order for the purchase of a product and/or services. You also agree to pay any applicable delivery costs for the delivery option selected by you.

(e) Payment for your order must be made by the method selected on the Website or the Mi Store. Payment is taken in the currency displayed on the Website or the Mi Store. You are solely responsible for any fees and charges associated with any currency exchange or charged by your bank or other provider.

(f We may make discount coupons or vouchers available from time to time. The terms of these coupons or vouchers will apply as set out on the coupon or voucher.

(g) We will issue you with an invoice or a receipt to the email address that you provide to us confirming receipt of payment.

3. Cancellation of orders

(a) You may be able to cancel your order within a short period after ordering. Please contact us as soon as possible if you wish to cancel your order, and we will let you know if it is possible to do so.

(b) Xiaomi may cancel your order if you fail to make payment for the products and/or services, if the product is out of stock or has been withdrawn, or there is an error in the price, image or the product description.

4. Delivery

(a) We will deliver the product(s) to the place of delivery using the delivery method that you specify and select when you place your order.

(b) You must ensure you provide us with correct delivery details including your name or the recipient’s name, delivery address, contact details and any other information required by us. We are not responsible for any loss or damage caused by incorrect information provided to us by you.

(c) Title and risk in the product(s) will pass to you at the time of delivery of the product(s) to the place of delivery specified in your order.

(d) We only deliver our products purchased from the Website or Mi Store within Australia. We may reject or cancel any order that has a delivery address outside Australia .

(e) We endeavour to display delivery times for our products on our Website and the Mi Store and to confirm an estimated delivery timeframe when we accept your order. Some products may take longer to deliver and sometimes there may be delays in delivery. We will take reasonable steps to keep you updated on when you can expect to receive your product.

6. Licence to use the Website

(a) The Website and all related content are subject to copyright and other intellectual property rights. You acknowledge that the trademarks and logos displayed on the Website are the property of Xiaomi and you must not use any of the marks without our prior written permission.

(b) We grant you a limited, non-transferable licence to access and use the Website solely for your personal and non-commercial use in accordance with these terms and conditions and any applicable laws. 

(c) We (or our licensors) retain all right, title, and interest in and to the Website and all related content, and nothing you do on or in relation to the Website or any of the related content will transfer any intellectual property rights to you or, except for the licence referred to in paragraph (b), grant you any licence to exercise any intellectual property rights unless this is expressly stated.

(d) You must not reprint or electronically reproduce this Website or any related content in whole or in part, without our prior written permission. 

7. Your Mi Account

(a) To register a Mi Account which you may use on our Website or the Mi Site, you must complete the registration form provided by Xiaomi through the Website and accept the terms of our User Agreement.

(b) If you are under the age of 18, you must obtain the consent of your parent or guardian prior to registering for a Mi Account.

(c) Our loyalty program associated with the Mi Account is called Mi Points. Please see the terms and conditions for Mi Points here

(d) You must keep your account username and password for your Mi Account safe, and must not share any username and password with any other person. You are solely responsible for all purchases or products through our Website or the Mi Store that occur under your account. We will assume that any use of the Website or Mi Store made using your username and password is you, and you will be responsible for any such use, except where you have notified us.

(e) You must immediately notify us if you become aware of any improper use or disclosure of your username and password, in which case we will cancel your username and password and we may provide a new username and password to you.

8. Using the Website

(a) In using the Website, you must not:

i. provide us with inaccurate or incomplete information;

ii. violate any applicable laws, or use the Website for any purpose that is unlawful or prohibited by these terms and conditions;

iii. impersonate any person or use a false email address;

iv. distribute viruses, Trojans or spyware, corrupt files, carry out denial of service attacks or use any other similar software or programs that may interrupt the functionality of our Website or damage the operation of any computer hardware or software;

v. infringe any intellectual property or proprietary rights, or rights of publicity of any third party;

vi. disseminate, transfer or store information or materials in any form or format that are harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous or otherwise objectionable or that otherwise violate any applicable laws or rights of any third party;

vii. use any software or technologies to intercept, mine, scrape or otherwise collect information from our Website or collect or store personal information about any users of our Website; or

viii. engage in any other conduct that inhibits any other person from using or enjoying the Website.

(b) If you do not comply with the above restrictions, we may terminate your account and we may also report any unlawful behaviour to law enforcement. You also agree to indemnify us, our affiliates and our respective directors, officers, employees and agents against any losses, liabilities, claims and expenses (including legal fees) that arise out of or as a result of your unauthorised use or misuse of our Website or the Mi Store.

(c) You are responsible for any information or materials in any form or format that you upload, post, transmit or otherwise disseminate using the Website including the opinion posting service.

(b) Please be aware that internet transmissions are never completely private or secure and that any message or information you send to us via the Website or Mi Store may not be secure. Any transmission is at your own risk.

10. Links to third party websites

(a) Our Website and/or the Mi Store may contain links to other website and/or advertisements which contain embedded links. Xiaomi is not liable for the content of such websites and is not responsible for the privacy or other practices of that website.

(b) We are not responsible for the content or accuracy of any linked websites and we do not endorse the content of any linked website or the subject matter of the advertisement. You should review the terms of use and privacy policies of each website you visit, as you do so at your own risk.

11. Warranties and liability

(a) (a) We provide this Website and its contents on an “as is, as available” basis, and we make no representation as to the accuracy, completeness, currency or reliability of the information contained on this website.

(b) Nothing in these terms and conditions excludes, restricts or modifies any guarantee, term, condition, warranty, right or remedy implied or imposed by any applicable law or regulation (including the Australian Consumer Law) which cannot lawfully be excluded, limited or modified.

(c) Our liability to you is reduced to the extent that your acts or omissions (or those of a third party) contribute to or cause the loss or liability.

(b) These terms and conditions are governed by the laws of New South Wales, Australia, and each party irrevocably submits to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.

(c) If any provision of these terms is found to be invalid or unenforceable, it will not affect the validity of the remaining provisions of these terms and conditions, which will remain in full force and effect.

(d) The term “including” when used in these terms and conditions is not a term of limitation.
