本條款及條件(下稱「本條款」)適用於使用者於本網站瀏覽、購買、持有或使用電動滑板車及相關產品(下稱「本產品」)。使用者一經使用本網站或購買/使用本產品,即視為已閱讀、理解並同意遵守本條款。
These Terms and Conditions (the “Terms”) apply to users who browse, purchase, possess or use electric scooters and related products (the “Products”) on this website. By using this website or purchasing and/or using the Products, the user is deemed to have read, understood and agreed to be bound by these Terms.
法例適用及遵從義務 Applicable Laws and Obligation to Comply
1.1 使用者確認並知悉,根據香港現行法例,電動滑板車及其他電動可移動工具在法例上可能被視為《道路交通條例》(香港法例第374章)所指的「汽車」,並受該條例及其附屬法例規管。
1.1 The user acknowledges and understands that, under the laws currently in force in Hong Kong, electric scooters and other electric mobility devices may be regarded as “motor vehicles” as defined under the Road Traffic Ordinance (Cap. 374), and are subject to regulation under the Ordinance and its subsidiary legislation.
1.2 使用者亦知悉,根據運輸署就道路安全及交通管理所採取的一般政策,鑑於電動滑板車的構造及運作方式可能構成安全風險,現行政策下一般不會為此類電動裝置根據《道路交通條例》進行車輛登記或發出牌照。
1.2 The user further understands that, under the general policies adopted by the Transport Department in relation to road safety and traffic management, in view of the design and mode of operation of electric scooters which may pose safety risks, such electric devices are generally not registered or licensed under the Road Traffic Ordinance.
1.3 使用者須自行了解並遵守使用所在地適用的一切相關法例、法規、附屬法例及政府部門(包括但不限於運輸署)所發出的指引及公告。
1.3 The user shall independently understand and comply with all applicable laws, regulations, subsidiary legislation and guidelines or notices issued by government authorities (including but not limited to the Transport Department) in the place of use.
禁止使用範圍之確認 Confirmation of Prohibited Areas of Use
2.1 使用者確認並同意,根據香港相關法例規定,電動滑板車不得於任何公共道路、私家路(包括行人道)、行人路、自行車徑或其他供公眾使用的道路上使用。
2.1 The user acknowledges and agrees that, under the relevant laws of Hong Kong, electric scooters must not be used on any public road, private road (including footpaths), pavement, cycle track or any other road open to public use.
2.2 使用者明白並確認,在道路(包括但不限於所有公眾可連續或間歇進入的公路、大道、街、裡、巷、短巷、坊、停車場、通道、徑、路及地方,並且包括西北鐵路的車路)或私家路(包括但不限於根據普通法可限制公眾進入的每一大道、街道、裡、巷、坊、廣場、停車場、通道、徑、路及地方)(包括行人道)上使用未有根據《道路交通條例》(香港法例第374章)登記或領牌的電動滑板車,可能違反《道路交通條例》及/或其附屬法例,並可能同時觸犯其他法例。
2.2 The user understands and confirms that the use of an electric scooter which has not been registered or licensed under the Road Traffic Ordinance (Cap. 374) on any road (highway, thoroughfare, street, lane, alley, court, square, car park, passage, path, way and place to which the public have access either continuously or intermittently and includes the carriageway of the North-west Railway) or any thoroughfare, street, lane, alley, court, square, car park, passage, path, way and place to which access by the public may be restricted under common law, including footpaths, may contravene the Road Traffic Ordinance and/or its subsidiary legislation and may also breach other applicable laws.
法例責任及法律後果 Legal Liability and Legal Consequences
3.1 使用者確認並知悉,任何人士如在道路或私家路(包括行人道)上駕駛未有根據《道路交通條例》(香港法例第374章)登記或領牌的電動滑板車,可能觸犯該條例第52條所訂的罪行。
3.1 The user acknowledges and understands that any person who drives an electric scooter which has not been registered or licensed under the Road Traffic Ordinance (Cap. 374) on a road or private road (including footpaths) may commit an offence under Section 52 of the Ordinance.
3.2 使用者亦知悉,根據現行法例說明,例如在道路或私家路(包括行人道)上駕駛未領牌的指定種類車輛,初犯者可被判處第二級罰款(現時為港幣5,000元)及監禁三個月,多次違反可被處第三級罰款(現時為港幣10,000元)及監禁六個月。
3.2 The user further understands that, under the current legal provisions, for example, driving an unlicensed specified vehicle on a road or private road (including footpaths), a first conviction may be punishable by a Level 2 fine (currently HKD 5,000) and imprisonment for three months, and repeated offences may be punishable by a Level 3 fine (currently HKD 10,000) and imprisonment for six months.
使用責任之承擔 Assumption of Responsibility for Use
4.1 使用者確認,本產品之任何使用行為,均須符合適用法例及相關規定。
4.1 The user acknowledges that any use of the Products must comply with all applicable laws and relevant requirements.
4.2 如因使用者違反任何適用法例、法規或政府指引,而引致任何法律責任、罰款、刑責、損失或開支,相關責任概由使用者按法例自行承擔,與本網站、平台營運方或銷售方無關。
4.2 If any legal liability, fines, criminal liability, losses or expenses arise as a result of the user’s breach of any applicable laws, regulations or government guidelines, such responsibility shall be borne solely by the user in accordance with the law and shall not be attributable to this website, the platform operator or the seller.
合法使用之免責聲明 Disclaimer of Lawful Use
5.1 使用者確認,本產品之設計、性能、技術規格或任何產品資訊,均不構成對其於任何公共道路或私家路(包括行人道)上合法使用的任何明示或暗示保證。
5.1 The user acknowledges that the design, performance, technical specifications or any product information of the Products do not constitute any express or implied guarantee that it can be lawfully used on any road or private road (including footpaths).
5.2 本網站並不就本產品在任何特定地點、方式或情況下的合法使用性作出任何承諾或確認。
5.2 This website does not make any representation or confirmation regarding the lawful use of the Products in any particular location, manner or circumstance.
