DOUBLE MI POINTS TERMS AND CONDITIONS

1.ORGANIZER AND PROMOTION

The following legal bases (hereinafter "T&C" and/or "Promotion Rules") govern the conditions of participation in the Promotion entitled "DOUBLE MI POINTS" (the "Promotion"), organised by:

(hereinafter referred to as the "Promoter")
The Promotion will be accessible via the local Mi Store App (hereinafter, the "App"). The Organizer shall also promote and announce the Promotion on local Mi.com and through the Promotion pre-heat webpage, accessible via the following link: https://event.mi.com/uk/app-special-deals.

2.ACCEPTANCE OF PROMOTION RULES AND THIRD PARTY TERMS AND CONDITIONS

(I) By participating in the Promotion, Participants hereby agree to (i) these Promotion Rules, as well as (ii) Organizer's Terms of Use and Privacy Policy, which can be viewed on the Participant's local mi.com website, and (iii) Mi Points General Terms and Conditions.
(II) The Organizer reserves the right to amend the T&C in whole or in part for technical, operational or commercial reasons, in which case the Organizer will publish this amendment together with the T&C on its own channels and official media platforms.
(III) In addition, the Organizer reserves the right to exclude from the Promotion, and therefore from the award of the Mi Points, any Participant who, in its opinion, has participated improperly or any Participant who defrauds, disrupts or disables the smooth and normal and lawful running and operation of this Promotion, including those who are proven or suspected to have acted improperly in the manner described above.

b.Third Party Disclaimer and Applicable Terms of Use and Privacy Policies

(I) Participants fully understand and acknowledge that social media or platforms owned by third parties - including but not limited to Twitter, Instagram, Facebook - that may be used in connection with the Promotion; do not sponsor, endorse or administer this Promotion in any way and should not be associated with this Promotion.
(II) In addition, Participants hereby acknowledge and agree that third party terms of use/service/sales and privacy policies - which shall include the Promoter's business partners, i.e. the e-commerce platforms designated herein - may apply in addition to these Terms.

3.TERRITORY

The Promotion is valid in the United Kingdom.

4.PARTICIPANTS

You must be of legal age (18 or over) in the Territory in which you reside to participate in this Promotion. In case of minors, you must be accompanied by your legal guardian to read and accept these Terms.
To participate, Participants must have an active mi.com account or download the Mi Store APP and log in (the "Participants" and/or the "Participant").
Participation is voluntary and free of charge, with the exception of Internet charges. Inaccurate or erroneous data will not be accepted in the Promotion.
Participants must be able to prove, at the Promoter's request and within a reasonable period of time, that they are eligible to participate in the Promotion prior to participation and/or at any time during the duration of the Promotion. Otherwise, the Organizer may disqualify Participants at any time.

5.TERM

This Promotion starts from 12:00 am (Local Time) November 1st 2021 and end on 23:59 pm (Local Time) December 25th 2021 (hereinafter the “Term” of the Promotion).

6.MECHANISM OF THE PROMOTION

You can access and participate on the Promotion through the App.
The Organizer will also announce and promote the Promotion via local Mi.com and the preheat webpage (https://event.mi.com/uk/app-special-deals).

6.1 Xiaomi Mi Points

Mi Points are the basis of the Xiaomi Mi Points Program, credited for qualifying activities to Participants personal mi.com account.

6.2 How to participate in the Promotion

During the Promotion Term, Participants may earn twice the usual amount of Xiaomi Mi Points by publishing reviews of Xiaomi products on the App (hereinafter the “Review”).
To be qualifying for earning twice the amount of usual Mi Points, Participants need to be logged into the App account when publishing the Review.
The Review can include: (i) only text; (ii) text and image; (iii) text or image and a video; of the Xiaomi product which is being reviewed. The amount of Mi Points* will vary depending on the type of Review as follows:

In addition, Participants may be credited an additional amount of 100 Mi Points per Review, which is chosen by the Promoter as to be shown in the local “Discovery Section”.

Only reviews for products actually bought on Mi Store App are eligible. Should a review be deleted, the Promoter reserves the right to withdraw the earned Mi Points.
Furthermore, the Participant is allowed to place more than one (1) Review for the same product, but only the first Review is qualifying for earning Mi Points, even if the Participant has deleted his initial Review.

7. XIAOMI MI POINTS PROGRAM

PLEASE NOTE THAT THIS PROMOTION IS SUBJECT AND BOUND TO XIAOMI’S MI POINTS PROGRAM AND TO ITS GENERAL TERMS AND CONDITIONS.

In case of any dispute or misinterpretation of the Promotion, the general terms and conditions of the Xiaomi Mi Points Program will prevail.

8.INTELLECTUAL PROPERTY AND IMAGE RIGHTS

By participating in the Promotion, Participants authorize the Organizer to reproduce and make available to the public, directly or through its media, the Participant's Review, the Review’s rating, the Mi Nickname and the Mi ID of the Participant granted by any means whatsoever, always in connection with the Promotion and/or for Promotion al or advertising purposes related to the Promotion. The aforementioned authorization, is granted free of charge and shall not entitle Participants to any consideration.
The Participant is fully and solely responsible for the Review and the content the Participant posts or communicates through the App. The Organizer shall not be liable for any infringements and/or violations committed by the Participant in connection with this Promotion. The Participant warrants that the Review submitted during the Promotion is his/her own and that the Participant holds all the necessary rights.

9.PERSONAL DATA

Participants in the Promotion agree to provide the Organizer (which shall be deemed to include Xiaomi group companies, parent or subsidiary companies, subsidiaries, affiliates, successors and assigns) with the collection of the following personal data:

The Organizer and its affiliated partner respect the privacy of Participants and are committed to protecting the privacy of Participants in accordance with their respective privacy policies and applicable laws.
Personal Data will be retained for as long as necessary to ensure that Participants are able to exercise their rights and take action in relation to the Promotion.

10.LIABILITY AND REPRESENTATION

10.1 ORGANIZER REPRESENTATION

Unless otherwise expressly stated in this T&C, Organizer and its affiliated or third-party promoters provide the Promotion on best effort basis only and exclude all warranties and conditions of any kind whether expressly or implied. In particular but without limitation, Organizer and its affiliated or third-party promoters do not warrant or represent that:

(i) The Promotion is fit for any purpose or meet Participants requirements or is provided without any errors or deficiencies or that the Promotion in compliance with any quality levels, as the case may be;

(ii) The Promotion is available to participant at any time and provided to Participant without disruption, interruption or delay;

(iii) Any information (whether oral or written) obtained by Participant from Organizer or as a result of Participants taking part in the Promotion (including any materials or products) will be suitable, accurate, complete, or reliable; and (iv) That any deficiencies in the Promotion, including any defects in performance, operation or functionality of the Promotion will be fixed, corrected or otherwise remedied.

10.2 ORGANIZER LIABILITY

Organizer is not liable to Participant, regardless of the legal grounds, in particular whether in contract, tort (including negligence) or any theory of liability, in or out of the connection with the participation in the Promotion for:

(i) Any indirect, incidental, special or consequential damages;

(ii) Any loss of income, business, actual or anticipated profits, opportunity, goodwill or reputation (whether direct or indirect);

(iii) Any damage to and/or corruption or loss of data (whether direct or indirect);

(iv) Any changes, modifications, extensions or limitations (including any suspension of Participants) in the Promotion.

(v) Access to Participants account and account data or Participants registration data) taking part of the Promotion, or any permanent or temporary cessation in the terms or conditions of the Promotions (or any part of them).

In the event that Organizer is liable for a breach of these terms, Organizer liability shall be limited to damages which Organizer must typically expect at the time of the conclusion of this terms due to the circumstances known at the time. Notwithstanding the above, such damages shall not be higher than 100 euros (or equivalent local currency).
Nothing in these terms shall exclude or limit Promoter:
a) Liability for death, personal injury or fraud or in accordance with any product liability act; and
b) Warranty or liability for damages or losses which may not be lawfully excluded or limited by applicable law. If the laws in the Participants jurisdiction do not allow the exclusion of certain warranties, terms or conditions or the limitation or exclusion of liability for loss or damage caused by negligence, breach of contract or breach of implied terms, or incidental or consequential damages, only the limitations which are lawful in that jurisdiction will apply to the Participants and Promoter’s liability and warranty will be limited to the maximum extent permitted by applicable law.

10.3 PARTICIPANTS LIABILITY

Participant is entirely responsible for any breach of the obligations under
(i) These terms; and

(ii) Any applicable law or regulation in the relevant jurisdictions, including the jurisdiction where you are a resident or from where you are participating in the Promotion.

(iii) And for the consequences of any such breach, including any loss or damage which Organizer or any third-party may incur or suffer. Organizer will have no responsibility to Participant or to any third party in respect of such breach.

11. LEGISLATION AND APPLICABLE JURISDICTION

Participation in the Promotion will be governed by the Promotion rules, which will be interpreted and applied in accordance with the United Kingdom law. The Participants have the option of filing claims at a competent court in the country in which they are resident.
