Xiaomi 14 Ultra Pre-order Campaign T&C

XIAOMI 14 ULTRA – PRE-ORDER TERMS & CONDITIONS ("CAMPAIGN")

 

 1.           Introduction

1.1         The Xiaomi 14 Ultra Pre-order ("Campaign") website, https://event.mi.com/sg/xiaomi-14-series/ (“Site”), this offer is limited to selected Xiaomi smartphones (only applicable to the following specific models: Xiaomi 14 Ultra) (hereinafter the “Product(s)”) purchased through any Xiaomi official sales channels (online or offline Dealer) and activated in the Territory of Singapore (hereinafter the “Territory”). This offer is provided by Xiaomi H.K. Limited registered at Suite 3209, 32/F, Tower 5, The Gateway, Harbour City, 15 Canton Road, Tsim Sha Tsui, Kowloon, Hong Kong  (hereinafter “Xiaomi” or “we”). The terms and conditions stated herein ("Terms and Conditions") of this Campaign on which Xiaomi offers you ("Customer") access to and use of this Site for the purposes of this Campaign. Whilst the Campaign includes the pre-order Xiaomi 14 Ultra Pre-order, the pre-order via the Site is provided by Xiaomi and its affiliates are not a party to the pre-order between the Customer and Xiaomi official sales channels. The Customer shall have no other cause of action or claim against Xiaomi under this Site.

1.2         Customer agrees to comply with all the Terms and Conditions when accessing or using this Site.

1.3         By participating in this Campaign and with the purchase of Xiaomi 14 Ultra at this Site, Customer will be entitled to free gifts which consist of:

i.            Xiaomi 14 Ultra Photography Kit

ii.           Google One (6 months, 100GB Cloud Storage Plan*)

iii.          1+1 Year (24 Months) Extended Warranty

iv.          1 Free Screen Replacement (within 6 Months from Date of Purchase)

v.           YouTube Premium ( 3 Months Access*)

herein refer to as “Free Gift”. Do refer to website for details. The free gifts are based on first come first serve basic and while stock last.

1.4         The pre-order quantity in this Campaign is limited to first come first serve basis and subject to stock availability.

1.5         The sale transaction in this Campaign is only between Dealers, the selected outlet and the Customer. Xiaomi only provides the recommended retail price and guidance on its website.

2.           Campaign Mechanics

The following are the steps for the Campaign:

Step 3:   Fill in your Contact Number

Step 4:   Fill in your E-mail Address

 

                     Go to the chosen collection point

                     Verify your Name as per Identity Card with pre-order registration email

                     Pay full amount to secured the pre-order free gifts

 

3.           Duration

This Campaign will run from 9 March 2024, 00:00:00AM to 22 March 2024, 11:59:59PM ("Campaign Period").

Xiaomi reserves the right to shorten, extend or cancel the Campaign Period without prior notice and while stocks last.

 

4.           Eligibility

4.1         This Campaign is opened to public of 18 years old and above (as of 09 March 2024) with Identity Card or Passport.

4.2         Each Customer is only entitled to pre-order one (1) unit of either Xiaomi 14 Ultra.

 

5.           Payment

5.1         Customer acknowledges, understands and agrees that all transactions are between Customer and Xiaomi selected outlet only. Xiaomi only acts as the coordinating party and is not involved in any sale and purchase of this Campaign.

5.2         Customer is not allowed to cancel the pre-order of the pre-ordered Xiaomi 14 Ultra as well as the selected collection outlet once Customer has successfully completed and confirmed the transaction.

5.3         Customer is required to make full payment via cash or credit card (Visa or MasterCard) through the Xiaomi official sales channels.

 

 

6.           Collection Date & Warranty of Free Gift

6.1         If the order is successfully secured by the Customer during the Campaign, the Customer is required to collect the pre-ordered Xiaomi 14 Ultra during the operation hours from the selected collection outlet under the terms below:

1.                   Collection period shall be from 23 March 2024 (10:00 am onward) to 7 April 2024 (until the selected outlet closes for the day) (“Collection Period”); and

2.                   There shall be NO collection allowed after 7th April 2024 and the Pre-order contract shall be cancelled with the Deposit forfeited. Such pre-order shall be declared null and void after 7th April 2024.

6.2         Free Gift shall be given based on first come first serve basis, while stock last and to be collected during the Collection Period. Customer shall be advised on a given date or the next day to pick up the Free Gift should the Free Gift is not available on collection day.

6.3         Free Gift shall have a 6 months limited warranty period from the date of collection* (for Xiaomi 14 Ultra Photography Kit only). Customer shall require to bring the invoice of the said purchase issued by the dealer and the Free Gift to any Xiaomi After Sales Service Centre for warranty claim.

6.4         Xiaomi reserves the right to change the collection date without prior notice.

             

* The warranty period for the free gift is 6months, with replacement offered instead of repair.

 

7            Customer's Covenants

7.1         In connection to this Campaign and placing the Pre-Order, Customer will not use this Site:

1.                   to submit fraudulent order, false, inaccurate, misleading, defamatory, or libellous information;

2.                   to transfer Customer's pre-order to another party;

3.                   to distribute viruses or any other technologies that may harm Xiaomi, or the interests or property of other users;

4.                   to export the unit purchased except in compliance with the export control laws of relevant jurisdictions and in accordance with posted rules and restrictions;

5.                   in the event Xiaomi suspects or discovers that the Customer is abusing this Campaign and/or Xiaomi in any of the ways mentioned above or otherwise, Xiaomi may, at our sole discretion, take necessary steps to prevent and mitigate such abuse such as limiting, suspending, or terminating the Customer's user account(s) and access to this Site, delaying or removing hosted content, removing any special status associated with Customer account(s), reducing or eliminating any discounts, and taking technical and/or legal steps to prevent Customer from using this Site.

 

8.           Limitation of Liability

8.1         Xiaomi uses its reasonable effort to keep this Site safe, secure, and functioning properly, but Xiaomi does not guarantee the continuous operation of or access to this Site.

8.2         Customer agrees that he/she is making use of this Site at his/her own risk, and that it is being provided to Customer on an "AS IS" and "AS AVAILABLE" basis.

8.3         To the extent permitted by applicable law, Xiaomi excludes all express or implied warranties, terms and conditions including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8.4         Customer shall assume full responsibility in case of any accident, damage or claim resulting from participating in this Campaign.

8.5         Customer shall be deemed to have performed a legally binding contract upon his/her submission of the pre-order and there shall not be any refund or costs whatsoever arising from his/her violation of the minimum age stated herein.

8.6         Warranty of the Xiaomi 14 Ultra is subject to standard product warranty coverage as per terms and conditions of the warranty as stated in Xiaomi’s official website at https://www.mi.com/sg/support/warranty/ . Customer is advised to check the abovementioned website from time to time and stay informed for any changes on the terms and conditions of the warranty.

8.7         All transportation, personal costs and/or any other costs, fees and/or related expenses arising out of the collection of the pre-ordered Xiaomi 14 Ultra are the Customer's sole responsibility.

 

9.           Indemnity

Customer will fully indemnify and hold Xiaomi (and our affiliates, and our and their respective officers, directors, employees, agents) harmless from any claim or demand, including reasonable legal fees, made by himself/herself or any third party due to or arising out of his/her breach of these Terms and Conditions, improper use of the site or breach of any law or the rights of a third party.

 

10.         Privacy

By providing Customer's personal data, Customer is indicating that he/she has read, understood and agreed that his/her personal data will be recorded, stored or otherwise processed in accordance to the Privacy Policy stated on this Site.

 

11.         General

 

11.1       Xiaomi reserves the right to make amendments to the Terms and Conditions of the Campaign herein without prior notice.

11.2       Access to any third-party websites is solely at the Customer’s risk and Xiaomi assumes no liability and is not responsible for any content, the accuracy or reliability of any products, services, information, data, opinions, advice or statement made on these linked websites. Nor is Xiaomi liable for any security or security practices of these third-party websites. Use of these third-party websites are entirely at the Customer’s own risk. The inclusion of any links does not imply any endorsement in any form on the part of Xiaomi.

11.3       Xiaomi reserves the right to disqualify any submissions for pre-order in the event of violation of any of the Terms and Conditions.

11.4       In the event of any discrepancies between the information that Customer has submitted with regards to the pre-order and the information provided during collection of the Xiaomi 14 Ultra at the selected collection outlet for any reasons whatsoever, Xiaomi shall not be responsible for any loss or costs arising from such discrepancies howsoever caused.

11.5       In case of any dispute, Xiaomi reserves the right to make the final decision and shall have the right to cancel, disqualify the pre-order and/or forfeit the deposit necessarily.

11.6       By participating in this Campaign, Customer fully and unconditionally agrees to and accepts the Terms and Conditions stated herein. Customer agrees to be bound by and abide to the Terms and Conditions stated herein including any amendments, modifications and /or interpretation thereof.

11.7       Xiaomi reserves the right to modify the Terms and Conditions stated herein without prior notice, at its sole and absolute discretion.

11.8       In the event of an electronic, computer, operational and/or technical error affecting the details, pricing or quantity of the product on the website, Xiaomi reserves the absolute right to rectify such error and/or cancel any transaction which has been entered into in reliance of the said error.

11.9       If any of the Terms and Conditions stated herein shall be found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, the invalidity and unenforceability of such terms and conditions shall not affect the other provisions and all provisions not affected by such invalidity and unenforceability shall remain in full force and effect.    

11.10     By participating in this Campaign, Customer agrees to grant Xiaomi and their respective parent companies, subsidiaries, affiliates, licensees, directors, officers, agents, independent contractors and advertising/promotion agencies the use of his/her full details submitted through this Campaign, without further compensation, unless prohibited by law.

11.11     In the event of inconsistencies between the terms and conditions found elsewhere with regard to this Campaign (if any) and the Terms and Conditions herein, the latter shall prevail.

11.12     These Terms and Conditions herein shall be governed by the laws of Singapore and the jurisdiction of the courts of Singapore.
