Terms and Conditions - Trade-In Services of Devices

For the purpose of this document:

“CompAsia” shall mean CompAsia Co Ltd (Company No: 0105561047026) as the provider of the Trade-In Services.

“Customer”/ “You / Your” shall mean the customer who successfully submitted order to CompAsia for the Trade-In Services and confirmed/ accepted by CompAsia.

“Device / Devices” shall mean any portable electronic equipment that has a display screen, supports one or more wireless network connectivity options, operates using voice, touch or a miniature keyboard including mobile cellular devices with a valid IMEI, laptops and tablets with unique serial number. It does not include any Device Accessories.

“Device Accessories” shall mean anything that is either provided by the OEM with a Device or sold separately to be used in conjunction with a Device. It includes batteries, SIM cards, memory cards, chargers, ear buds, boxes, cases, cables, styli, mounts and docking stations.

“OEM” shall mean the original manufacturer of the Device.

“Terms and Conditions” shall mean the terms and conditions as hereunder stipulated which shall govern the Trade-In Services of Devices between the Customer and CompAsia and as may be amended by CompAsia from time to time.

“Trade-In Services” shall mean the services offered by CompAsia to the Customer for the trade-in and sale of the Customer’s Devices to CompAsia.

To be eligible for the Trade-In Services, the Customers acknowledge that their Devices must meet the condition criteria set out by CompAsia and subject to the Terms and Conditions.

By placing order for and using the Trade-In Services, you hereby acknowledge that you have read and understood the Terms and Conditions and agree to be bound by these Terms and Conditions.

You shall ensure that all information including but not limited to your data related to your Devices and personal information provided to CompAsia for CompAsia to conduct the Trade-in Services is accurate, complete and non-misleading and you shall not impersonate any other person.

You acknowledge that upon CompAsia’s receipt of your order for the Trade-In Services in respect of any Device, CompAsia reserves the right to (i) refuse your order, (ii) refuse to purchase any or all items/ Devices in your order for the Trade-In Services or (iii) limit the number of purchases at CompAsia’s sole discretion, without having to assign any reasons thereto.

You represent that you are the legal owner of the Device. In addition, you shall ensure that all Devices provided to CompAsia under the Trade-In Services (i) shall comply with the requirements as stipulated by CompAsia and (ii) shall be free from any liens or encumbrances.

Age restriction- Your age must be 18 years and above to obtain the Trade-In Services.

All the logos, trademarks, texts, graphics, button icons, images, digital downloads, data compilations and software used in connection with the Trade-In Services are and shall remain as the exclusive property of CompAsia.

By using the Trade-In Services and providing your contact details including phone number, you hereby grant CompAsia with the permission for the use of text messages, pre-recorded voice and/or automatic telephone dialling systems to contact you and/or deliver CompAsia’s information, offers or announcements.

You agree that the ownership of and any rights to the Device shall be transferred to CompAsia and CompAsia is deemed to have discharged its obligations under the Trade-In Services once the payment of the trade-in value of the Device is made to you.

You agree and acknowledge that the Device’s initial quoted value may be subject to changes due to various reasons including but not limited to the actual conditions of the Device.

If the details or the actual condition of your Device does not match the make, model or conditions of the order or information relating to the Device provided by you to CompAsia, CompAsia will revalue and provide a Final Quotation (as defined hereinafter) for the Device .

Disclaimer: Any data stored or contained in your Device (whether in the form of personal details, SMS, photos, games, songs or other data) will be erased by CompAsia. The erasure of the data stored in your Device as specified above will be performed in best endeavours. You shall be responsible for any data stored in the Device and shall not hold CompAsia responsible or liable for any data left in the Device or any loss, misappropriation or damage to any data or information left therein.

Amendment: These Terms and Conditions may be changed or updated by CompAsia from time to time at CompAsia’s sole discretion by posting a revised version on CompAsia’s website and/or app. You acknowledge that it is your responsibility to regularly check for any amendments or updates to the Terms and Conditions and keep yourself updated with the revised/ updated Terms and Conditions. Your continued use of the Trade-In Services shall be deemed as your agreement to the revised Terms and Conditions and CompAsia shall not be held liable for any damages or losses incurred by you therefrom. Each of your order for the Trade-In Services shall be governed by these Terms and Conditions applicable at that time.

Indemnity: You agree and acknowledge that by using the Trade-In Service, you shall indemnify and release CompAsia from any claims, losses or damages that may arise out of or in connection with your access and use of the Trade-In Services, including any claims related to the ownership of the Device and any data stored in it.

You shall waive all claims, losses, costs, and expenses in relation to your Device once it has been deemed abandoned by CompAsia pursuant to the Trade-in Process herein below.

Blacklisted/stolen devices: When placing an order to CompAsia for the Trade-In Services, you will be deemed as the legal owner of the Device as provided to CompAsia. CompAsia will validate the IMEI/Serial number of the Devices through Singaporean Police Force. In the event that your Device is found to be a blacklisted or stolen Device, CompAsia reserves the right to deliver the Device and your personal details to the authorities, in which case, you shall comply with the indemnity clause above.

These Terms and Conditions are governed by the laws of Singapore and any disputes arising from these Terms and Conditions shall be referred to the courts of Singapore.

CompAsia may immediately terminate the Trade-In Services to you at any time if CompAsia believes that (i) you are using the Trade-In Services in a way that may adversely impact the reputation of CompAsia; (ii) you are using the Trade-In Services in a manner which may be fraudulent, illegal or relate to any criminal activity; (iii) you have breached or are likely to breach these Terms and Conditions; or (iv) you have provided CompAsia with inaccurate, false or incomplete information.

Your use of the Trade-In Services is subject to the terms of use and the privacy policy of CompAsia which can be https://compasia.sg/pages/privacy-policy.

Trade-in Process

Placing the order: You shall declare your Device’s condition accurately in all respects based on the questionnaire set by CompAsia to get the estimated trade-in value of the Device. If you are agreeable at selling your Device at the given price, then proceed to fill-in your personal details. You shall provide your bank account details to CompAsia for the payment of the trade-in value of the Device. CompAsia shall not be responsible for failure of payment due to inaccurate or incomplete details provided by you to CompAsia.

Home pick-up / Drop-off within Singapore: After the order placement, subject to acceptance by CompAsia, your order & schedule will be verified for Device’s collection / drop-off. A personnel from Pickupp, a 3rd party logistic service provider’s will meet you at your preferred location for the Device’s collection or you can drop-off your Device at the following locations: CompAsia HQ:

Adjusted Price:You understand and agree that upon CompAsia’s receipt of your order for the Trade-In Services, your Device is collected for the purpose of physical assessment to verify the actual condition of the Device. You acknowledge that the price which may have been quoted by CompAsia based on the information provided by you relating to your Device prior to the pick-up or drop off of your Device is preliminary and subject to the physical assessement of your Device aforementioned (“Initial Quotation”). CompAsia will revalue and re-quote the Initial Quotation of the Device according to the actual condition of the Device which could either be the same or a newly quoted price. You shall subsequently have the option to accept or reject the price quoted for your Device after the revaluation and requotation being performed by CompAsia (collectively "Final Quotation”). CompAsia shall inform you on the Final Quotation immediately for all products except for laptops which shall be inform within five (5) working days from the laptops pick-up or drop off date.

Pick-up Fee: If you opted for a Device home pick-up service, a pickup fee shall apply and will be deducted from the Initial Quotation of your Device. Subject to the Final Quotation, the net amount payable to you will reflect this deduction, if applicable. For avoidance of doubt, the pickup fee shall not be charged in the event that you do not agree with the Final Quotation and require a Device Return.

Device Return: If you are agreeable with the Final Quotation, you will be requested to sign-out of all the accounts in your Device and perform a factory reset on the Device you agree to sell to CompAsia under the Trade-In Services. After completion of factory reset, you will receive your payment. If you do not agree with the Final Quotation and/or the Device is locked due to Find My iPhone Activation Lock (FMiP), then there is no charge and you shall collect your Device from CompAsia as soon as practicable (“Device Return”). Upon the official handover of the device to CompAsia, the ownership of the device shall be transferred to CompAsia with immediate effect and cannot be returned to the customer for any reason (with the exception of laptops, which will only officially be under the ownership of CompAsia once the final quotation is issued and accepted).

Abandonment of Device: In the event of a Device Return, if you fail or refuse to collect, accept, and/or receive your Device despite multiple efforts by CompAsia or its logistic partners within a period of 60 days from the date of CompAsia’s first correspondence to you in providing the Final Quotation via WhatsApp, you shall be deemed to have abandoned your Device and you hereby give CompAsia the right to deal with your abandoned Device in a manner CompAsia shall deem fit without further reference to you and in accordance with applicable law.

Payment: CompAsia will pay you the trade-in value of your Device after deducting any applicable pickup or logistics charges as agreed between the parties.
