These Terms and Conditions apply to all purchases made and all Services offered on mi.com/sa-en and Mi Store App. Please read the Terms and Conditions carefully to learn about your rights and obligations.

The legal statement, privacy policy, platform specification, notices, announcements, operating rules, help documents and other binding documents available to the User on the Website, shall be supplementary agreements to these Terms and Conditions with same legal force. If User uses the services of the Website, it shall be deemed as an implied acceptance by User to the above supplementary agreements.

I.  Definitions

Buyer: You, a natural person with full legal capacity, who have a Mi Account maintained under the terms of the Mi Account User Agreement and have logged in using a Mi Account on the Website. The Buyer is a Consumer, meaning they are an individual acting for purposes unrelated to their commercial, business, or professional activity. If the Buyer is not of legal age to enter into binding agreements with Xiaomi, the Buyer may use the services offered on the Website only upon obtaining consent from their legal representative and shall provide such consent to Xiaomi at any time upon Xiaomi's request.

Mi Account: the User's personal account on the Website, maintained under the terms specified in the Mi Account User Agreement and used, among others, to conclude and perform the Purchase Agreement and receive information from Xiaomi.

Product(s): Xiaomi, REDMI or POCO or another brand owned by Xiaomi-branded movable item available for purchase by the Buyer, available on the Website.

Purchase Agreement: a legally binding contract entered into between the Buyer and Xiaomi, governing the purchase and sale of products available on the Website.

Services: any service offered by Xiaomi or a third party, accessible through the Website. This encompasses services that are available for purchase as well as those offered without charge. The provisions of the Terms and Conditions relating to the Product shall apply accordingly to the Services, with the exception of the Service provided by the third party, to which the terms and conditions of the third party will apply, unless otherwise stated.

Terms and Conditions: these terms and conditions, which set out the conditions for the use of the Website and its functionalities, as well as the conditions for the purchase of Products from Xiaomi throughmi.com/sa-en) or Mi Store App.

User: the natural person using the functionality of Website, including the Buyer.

Website: ICT platform owned by Xiaomi Inc. Operator responsible for editing, maintaining, and overseeing the content of the Website is (Xiaomi Smart Co. Limited) assuming full responsibility for its accuracy, legality, and compliance with applicable regulations. The Website is a service provided electronically under the terms and conditions specified in the Terms and Conditions, enabling Buyer to familiarize themselves with the Products and Services offered by Xiaomi, browse the content posted on the Website, conclude a Purchase Agreement, make payments for the Products, posting the opinions or subscribe to Newsletter. The Website may display advertisements and other commercial content. Responsibility for the content of the Website lies with Xiaomi Smart Co. Limited; The Website also means the Mi Store App (the official Xiaomi mobile application available via https://www.mi.com/sa/appdownload/).

Xiaomi: The Seller, Xiaomi Smart Co. II. Applicability

1. These Terms and Conditions apply to all purchases of Products through the Website and all Services available on the Website, unless expressly otherwise agreed.

III. Prices

1. Xiaomi’s sales prices are quoted in the currency displayed on the Website and include all duties, fees and other mandatory or statutory charges applied upon sales by Xiaomi, including VAT (if applicable).

2. While Xiaomi places significant emphasis on accurate pricing on the Website, there is a possibility of inaccuracies in the displayed prices, promotions, coupons, and other offers. Xiaomi reserves the right to withdraw from legal consequences of its statement of will and terminate the Purchase Agreement if it is indicated that the Buyer was aware of an error on the Website. This would occur especially when the difference between the market value of the Product and its selling price on the Website is materially lower, and the reduced price was not a result of a consciously organized promotion or clearance sale. Correspondingly, if Xiaomi has offered a Product at a price that is materially or obviously higher than the prevailing retail price for that Product due to a pricing error and accepted the Buyer’s order at that price, Xiaomi will allow the Buyer to cancel the Purchase Agreement and /or reimburse the Buyer for the disparity between the inflated price and the accurate price.

3.Unless otherwise agreed on the Website and in the ordering process, Xiaomi's delivery and administrative costs are included in the final price payable for the Product. Any fees or charges that will be added to the price of the Product will be visible to the Buyer during the ordering process and before the Buyer places an order.

4. Delivery costs for Products are detailed during the ordering process.

5. Payment can only be made by method available and listed on the Website. Payment is taken in the currency displayed and Xiaomi is not responsible for any currency or exchange rate discrepancies. All refunds to the Buyer will be made using the payment method used to place the binding order in the currency in which the Buyer made the payment.

6. Xiaomi may provide discount coupons as part of its advertising campaigns, which grant a reduction in the price of Products or Services, subject to the applicable terms and conditions in a given advertising campaign.

IV. Purchase Agreement

1. The information posted on the Website, including prices and descriptions of Products, does not constitute a commercial offer of Xiaomi, but only an invitation to Buyer to submit offers to conclude the Purchase Agreement.

2. The Buyer places an order by following the instructions displayed on the screen. To place an order, the Buyer must register a Mi Account and correctly complete the purchase form on the Website, in particular by providing correct contact details and data necessary for the delivery of the Product. Xiaomi is not responsible for erroneous or false data provided by the Buyer. The Buyer may correct an error in their contact details and data provided that the Buyer notifies Xiaomi via Customer Service Center within 24 hours from the time of purchase.

3.  To register a Mi Account, the Buyer should complete the registration form provided by Xiaomi through the Website. When completing the registration form, the Buyer shall read Xiaomi Account User Agreement and accept its content.

4.  The Buyer may place an order for Products 24 hours a day, every day, provided that there are no technical interruptions. Xiaomi will, whenever possible, inform on the Website about any technical interruptions in the operation of the Website.

5.  After the Buyer places an order on the Website, Xiaomi will send information regarding the order to the e-mail address provided by the Buyer. Until e-mail with information regarding the commencement of the process of delivery process is received, the Buyer has the right to cancel the order, without affecting the right to withdraw from the Purchase Agreement set forth in point VII of these Terms and Conditions.

6. Information about the order is automatically generated by the computer information system in accordance with the content completed by the Buyer. The contractual relationship is deemed to be established between the Buyer and Xiaomi only after receiving an e-mail confirmation sent by Xiaomi to the Buyer confirming the acceptance of the order and the availability of the Products ordered by the Buyer. Only those Products whose availability has been confirmed by e-mail from Xiaomi will form part of the Purchase Agreement and will be delivered to the Buyer.

7. The Buyer is solely responsible for paying any fees charged by the Buyer's bank, payment card carrier, or other provider of the Buyer's selected payment option. The Buyer understands and agrees that Xiaomi implements a payment method in advance of delivery. The required payment made by the Buyer for the purchase of the Products in a timely, full and legal manner is necessary for the effective execution of the Purchase Agreement between the Buyer and Xiaomi, and is also the basis for the delivery of the Products to the Buyer. If the Buyer fails to make payment in the appropriate manner or within the specified time, Xiaomi will have the right to cancel the order and withdraw from the Purchase Agreement.

8. Xiaomi documents the sale of Products by issuing a VAT invoice or receipt. Acceptance of the Terms and Conditions by the Buyer who is a natural person not conducting business activity is tantamount to submitting a request to issue a VAT invoice documenting the sale.

9. The Buyer accepts the issuance and sending of invoices in electronic form to the e-mail address provided when placing the order (unless the law requires otherwise). The moment of receipt of the invoice by the Buyer is deemed to be the moment of delivery of the e-mail with the invoice to the Buyer's e-mail address. Delivery means sending an e-mail with an invoice to the Buyer's mail server.

10. If the Buyer receives a refund of all or part of the payment (due to withdrawal from the Purchase Agreement, complaint or other reason) after issuing a VAT invoice, Xiaomi will issue a correction invoice. The provisions relating to invoices apply mutatis mutandis to correction invoices.

V. Execution of the Purchase Agreement

1. The Buyer's order as confirmed in accordance with clause IV, point 6 of these Terms and Conditions will be processed and fulfilled after Xiaomi has received payment from the Buyer through the designated payment method. Payment should be made within 48 hours, otherwise the order will be cancelled and Xiaomi will withdraw from the Purchase Agreement, subject to the situations where the Buyer opts for installment payments. In such a case the order will be cancelled from the timing depends on the internal process by which the installment payments provider needs to approve the installment payment, and when the Buyer receives a message that the order has been cancelled due to non-payment.

2. The Products will be delivered to the Buyer using the delivery method selected by the Buyer from among those listed on the Website. Available delivery methods may vary depending on the Product.

3. The Buyer shall accurately fill in the Buyer’s name, recipient's name (if applicable), delivery address, contact information and other necessary information required by Xiaomi. The Product purchased will be delivered at the delivery address specified. Any loss caused by the Buyer’s change of contact person or related delivery information shall be at the Buyer’s own risk. If the delivery is cancelled out of the following circumstances, Xiaomi shall not bear the responsibilities, consequences or costs and reserve the right to withdraw from the Purchase Agreement unilaterally:

(i)    The delivery address, contact information, etc., are incorrect, non-existent, or not detailed enough;

(ii)   Logistic company contacts the Buyers according to the logistic company policy, but is unable to connect or receives no answer;

(iii) Repeated delivery attempts are made due to the Buyer's absence, if such option is available according to the logistic company policy;

(iv) Force majeure, such as natural disasters, traffic, strikes, riots, government actions, sudden wars, etc.

4.  Xiaomi's delivery services are exclusively available for addresses located within the territory of (K.S.A.), which means that if the Buyer is purchasing from outside this territory, they will need to provide an address within the territory and then arrange for pick-up or delivery from there, at their own expense.

5. Xiaomi will inform the Buyer about the expected delivery date via the Website. The delivery time is counted in business days (days from Sunday to Thursday, excluding public holidays in the territory of (K.S.A.) and will usually last up to 4 days, subject to all delivery data is correctly provided by the Buyer.  Xiaomi will inform the Buyer about the expected delivery date via the Website. The Buyer also has the right to withdraw from the Purchase Agreement where delivery is delayed for more than 15 days from the date the Product was intended to be delivered.

6. Given the Website's focus on serving the consumer segment, the availability of Products on the Website might be limited to estimates of end users' needs. If the Buyer considers that availability limitations prevent them from reselling the Products, they may approach Xiaomi to discuss the entering into a reselling relationship as traders.

7. Due to technical obstacles and various other factors, Xiaomi cannot guarantee that all Products in the order submitted by the Buyer will be in stock. Xiaomi will use its best efforts to mark the out-of-stock Products. If the Products ordered by the Buyer are out of stock, both the Buyer and Xiaomi have the right to cancel the order, and if the Buyer has already paid, the payment will be refunded to the Buyer.

8.  In the case of Products purchased by the Buyer, Xiaomi will send the Products to the delivery address in the territory indicated in point 5 above, via a logistics company, with the exception of products that are only available for delivery in a specific area, which will be duly indicated on the Website. Xiaomi is not responsible for any damage or other undesirable consequences resulting from the Buyer’s behavior. If signature and acknowledgment are required, the Buyer or recipient will sign for receipt of the Products after reviewing the applicable delivery terms.

9.The price, quantity and availability of a Product on the Website may change at any time without prior/specific notice, provided that changes do not apply to orders already placed.

10. In the event that the order is rejected by Xiaomi's decision, the benefit (excluding the monetary value) including but not limited to the discount coupon or Mi Points, in the Buyer's possession before placing the order may be returned to the Buyer's account after submitting the application. Special conditions may apply to some coupons and they prevail over the provisions of the Terms and Conditions. If the Buyer's order is canceled for any reason, the shipping code (F Code) used to purchase the Products will no longer be valid and cannot be used again.

VI. Legal Warranty of Conformity of Products

1. Xiaomi is liable to the Buyer for the lack of conformity of the Product with the Purchase Agreement in the scope describe in general applicable law existing at the time of its delivery and which existed at the time of its delivery and was noticed at the time established by generally applicable law which apply to the Buyer, unless Xiaomi has specified a longer shelf life of the Product.

2.   Xiaomi shall be liable to the Buyer for any lack of conformity which exists at the time when the goods were delivered and which becomes apparent within two years of that time.

3.  With respect to the Products with digital elements, Xiaomi is liable to the Buyer at the time established by generally applicable law which apply to the Buyer, for lack of conformity of digital content or digital services with the Purchase Agreement delivered continuously, which occurred or became apparent during the period in which they were to be delivered under the Purchase Agreement.

4.  Xiaomi is not liable for the lack of conformity of the Product with the Purchase Agreement, if the Buyer, at the latest at the time of concluding the Purchase Agreement, was clearly informed that a specific feature of the Product deviates from the requirements for conformity with the Purchase Agreement specified above, and expressly and separately accepted the lack of specific feature of the Product.

5. If the Product is inconsistent with the Purchase Agreement, the Buyer may request its repair or replacement.

6. Xiaomi may choose to replace if the Buyer requests a repair, or Xiaomi may choose to repair if the Buyer requests a replacement, if meeting the conditions to adapt the Product to the Purchase Agreement in the manner chosen by the Buyer is impossible or would involve excessive costs for Xiaomi. If the costs of both repair and replacement are impossible or excessive, Xiaomi has the right to refuse to adapt the Product to the Purchase Agreement. In such a situation, the Buyer may exercise its right to a reduction in the price or to withdraw from the Purchase Agreement.

7. Xiaomi repairs or replaces the Product within a reasonable time after confirmation by Xiaomi of the lack of conformity of the Product with the Purchase Agreement.

8. The costs of repairing or replacing the Product are covered by Xiaomi. The Buyer is obliged to make the Product subject to repair or replacement available so that it can be collected by Xiaomi, which bears the delivery costs.

9. In the event of withdrawal from the Purchase Agreement, the Buyer shall immediately return Xiaomi's Product at Xiaomi's expense. Xiaomi refunds the price no later than 14 days from the date of receipt of the Product or proof of its return by the Buyer.

10. The Buyer may submit complaints regarding the Product or the execution of the Purchase Agreement in accordance with the provisions via the Website.

VII. Right to Withdrawal from the Purchase Agreement

1.  In accordance with Article 13(1) of the E-Commerce Law (issued by Royal Decree No. M/126, dated 10 July 2019),The Buyer has the right to withdraw from the Purchase Agreement within seven (7) calendar days without giving a reason provided that the Products are not ineligible for a refund under Part I, Article 7 of this Return Policy and the Product(s) are returned with the original packaging, sealed and unopened. The deadline for withdrawal expires after seven (7) days from the date on which the goods came into possession or on which a third party other than the carrier and indicated by the Buyer came into possession of the Product.

2.  If the Product(s) is with manufacturing problems, You can request replacement within fourteen (14) days from the delivery date (i.e. after fourteen (14) days, replacement is not applicable); OR You can apply to your legal warranty rights under K.S.A. Laws within two (2) years with the purchase agreement existing at the time of its delivery of the Product(s) unless Xiaomi has specified a longer shelf life of the Product(s).

3. In order to exercise the right to withdraw from the Purchase Agreement on time, the Buyer should send a declaration before the expiry of the withdrawal period.

4.  The Buyer has the option of submitting a declaration of withdrawal:

(i)  By e-mail to the address (service.sa@support.mi.com);

(ii)  By phone at the hotline number (8001202002) (Sunday to Thursday from 10:00 to 19:00);

(iii) Through the Order Centre or Internet Chat available on the Website;

5.In order to meet the withdrawal deadline, it is sufficient for the Buyer to send information regarding the exercise of their right to withdraw from the Purchase Agreement before the deadline to withdraw from the Purchase Agreement.

6.  Following withdrawal, the Buyer shall be responsible for the proper care and maintenance of the Product, exercising due diligence to ensure their preservation and protection until their return to Xiaomi.

7. The Buyer will, after sending the information about the exercise of the right of withdrawal, receive an e-mail confirming receipt of the statement by Xiaomi.

8.  The Buyer shall send back the Product without undue delay and in any event not later than 14 calendar days from the date of receipt of the return label. The deadline is met if the Buyer sends back the Products before the period of 14 calendar days has expired.

9. The returned Product must be packed in accordance with the instructions provided by e-mail and available on the (https://www.aramex.com/sa/en/track/shipments) website. The returned Product must be accompanied by a correctly completed return label and proof of purchase.

10. Together with the returned Product, the Buyer is obliged to return any accessories, promotional items or gifts that was received with the Product.

11. Xiaomi shall immediately, but no later than within 14 days from the date of receipt of the Buyer's statement of withdrawal from the Purchase Agreement, reimburse to the Buyer all payments made by them, including the costs of initial delivery of the product (with the exception of additional costs resulting from the delivery method chosen by the Buyer other than the cheapest usual delivery method available on the Website). Xiaomi reserves the right to deduct from the original Product value any reduction attributable to Product defects.

12. Xiaomi reserves the right to withhold the refund until the Product is returned or the Buyer provides proof of sending it back, depending on which event occurs first.

13. Xiaomi covers the delivery costs in the event of returning the Product based on withdrawal from the Purchase Agreement. Xiaomi reserves the right to refuse to cover the costs of returning a product if, due to the nature of the product (e.g. size or weight), it cannot be returned by regular post.

14. If Xiaomi offers Products together, in the bundle, withdrawal from the Purchase Agreement means withdrawal from the purchase of the set and thus the effect of withdrawal is the obligation to return all the Products included in the bundle.

15.   Xiaomi may refuse a refund in the following cases:

(i) The return period has expired - If the product return period of 7 days has expired, it can no longer be returned.

(ii)  The Product is non-returnable - Products cannot be returned: (i) which were not purchased on the Website; (ii) which were non-prefabricated, manufactured according to the Buyer's specifications and intended to meet their individual needs (unless such Products are defective or do not meet the agreed specification); (iii) which, after delivery, due to their nature, become inseparably combined with other items; (iv) which are delivered in a sealed packaging which, once opened, cannot be returned if the packaging has been opened after delivery; (v) online, downloadable or digital versions of the software (unless such Products cannot be downloaded due to a software issue or do not conform to the agreed specification); and (vi) software, audio and video recordings in an open package.

VIII. Force Majeure

1.  To the extent permitted by law, Xiaomi is not liable for interruptions in the operation of the Website caused by force majeure. In the event of a force majeure situation (including but not limited to strikes, pandemics, extreme weather conditions, embargoes and any other situation which is beyond the control of Xiaomi), Xiaomi’s obligations under these Terms and Conditions are suspended during the period of the force majeure situation.

IX. Commercial Guarantees

1.  Xiaomi provides a commercial guarantee for selected Products. For Products covered by commercial guarantee, information regarding the existence and content of the commercial guarantee is presented on the Website. Xiaomi extends a commercial guarantee for select Products. The exercise of rights under the commercial guarantee does not affect the Xiaomi's liability under the legal warranty set forth in point VI. of these Terms and Conditions. X.  Complaints

1.  All complaints related to:

(i)    Product;

(ii)   Services, including using the Website.

can be submitted through the phone numbers, email address, web links or postal addresses indicated on the Website.

2.  The complaint should contain the Order Number, name, surname, exact address (in case of choosing the method of responding to the complaint in writing) or e-mail address (in case of choosing the method of responding to the complaint electronically), as well as a detailed description and justification of the complaint.

3. Xiaomi is not obliged to respond to any complaints raised through the use of social media (e.g. Facebook, Twitter).

4.  The complaint will be considered within 14 days from the date of its receipt, based on the applicable laws and these Terms and Conditions.

5.   In order for the Xiaomi to handle a complaint by phone or email, please provide:

(i)    order number, if applicable,

(ii)   User's name and address,

(iii) E-mail address,

(iv) a description of the basis for the complaint, and

(v)   what remedies or actions are required from Xiaomi.

XI. Export

1.  Upon using the functions and services of the Website or purchasing goods Buyer understand and agree that: The Website and the functions, services and goods provided through the Website are subject to the export controls and economic sanction-related laws of multiple jurisdictions applicable laws containing restrictions on destination, end user and end use, including but not limited to: (1) not to use of any functions, service or goods for any activities related to endanger national security and interests military end uses, support of terrorism, nuclear facilities, chemical or biological weapons, missiles, design, develop, produce or use proliferation of weapons of mass destruction and their means of delivery, etc.; (2) comply with all export, re-export and resale restrictions applicable to the goods.

2. If Buyer's use of the functions and services being provided through the Platform violates, or in Xiaomi's reasonable opinion may violate, the requirements and restrictions of relevant laws, resulting in a compliance risk or adverse impact on the Platform, functions and services and supply of goods, the Platform reserves the right to suspend, restrict or terminate the provisions of all or part of the Products.

XII. Privacy Policy

2.  Before using the Website, the User should read and accept mi.com privacy policy.

XIII. Using the Website

1.  The Website is a service provided electronically under the Terms and Conditions. Via the Website, the User may, in particular, become acquainted with the Products available on the Website, post opinions, or subscribe to the Newsletter.

2.  Anyone that uses the electronic functionalities of the Website and, in particular, the possibility of posting opinions mentioned below (the "Functionalities") is deemed to be a User subject to the Terms and Conditions. The opinion posting service entails enabling the User to publish individual and subjective statements regarding the Products as provided by the Buyer. The specific regulations governing the publication of opinions are set forth in point XIII. (12) below.

3.  The services specified in point XIII. (1) are provided 7 days a week, 24 hours a day. Xiaomi does, however, not guarantee, represent or warrant that Buyer's use of the Website will be uninterrupted or error-free.

4.  Xiaomi reserves the right to choose and change the type, forms, time, and manner of granting access to the services specified in point XIII. (1), of which it will inform the User in a manner appropriate to the change of the Terms and Conditions.

5.  The User may terminate the service specified in point XIII. (1) at any time, without giving any reason and with immediate effect.

6. The Newsletter consists of sending messages containing information about new Products by Xiaomi or Xiaomi's affiliates to an e-mail address. The newsletter is sent by Xiaomi to all Users who have subscribed to this service.

7. The minimum technical requirements enabling the use of the Website are an internet browser in a version supported by the manufacturer with JavaScript support enabled and an internet connection with a minimum bandwidth of 512 kbit/s. The Website of the Service is responsive and dynamically adjusts to every screen resolution.

8. Access to the Website is also possible through the Mi Store mobile application, which is available for download on mobile devices from mobile application stores (availability of the mobile application at for Arabic: https://www.mi.com/sa-ar/appdownload & for English: https://www.mi.com/sa-en/appdownload). Downloading and using the mobile application is free of charge. At any time, the Buyer may cease to use the mobile application.

9.      All rights to the Website, including intellectual property rights, belong to Xiaomi or Xiaomi affiliates. All product names and descriptions, in particular trademarks and images, belong to their respective legal owners and have been made available on the Website solely for informational purposes. The use of the above materials made available on Xiaomi's Website may only occur in a manner specified and in compliance with applicable laws.

10.   Xiaomi declares that the public nature of the Internet and the use of electronic services may involve the risk of unauthorized acquisition and modification of the User's data by unauthorized persons. Therefore, User's should use appropriate technical measures to minimize the aforementioned risks. In particular, they should use security programs to protect against cyber threats (e.g., malicious software, fake websites used for data phishing) and to protect the identity of Internet users.

11.   It is prohibited for the User to provide unlawful content and to use the Website or free services provided by Xiaomi in a manner contrary to the law, good morals, or infringing upon the legal rights of third parties. If the User or any other person or entity considers that the content published on the Website violates their personal rights, decency, feelings, morals, beliefs, principles of fair competition, know-how, a secret protected by law or under an obligation, they may notify Xiaomi of a potential infringement.

12.   If the User has their place of establishment or is located in the K.S.A., the provisions regarding unlawful content in the following paragraphs shall apply to them:

(i)    Xiaomi does not undertake any general obligation to monitor whether the User's use of the Functionalities entail the upload of illegal content or any other illegal activities, for which Xiaomi shall not be liable to the extent that Xiaomi does not have actual knowledge or, as regards claims for damages, is not aware of facts or circumstances from which the illegal content or activities is apparent. However, Xiaomi is entitled to carry out on its own initiative investigations or other activities aimed at detecting, identifying and removing, or disabling access to, illegal content or taking other necessary measures to comply with the requirements resulting from the applicable digital regulations.

(ii)   In particular, Xiaomi is required to promptly inform, upon becoming aware, in relation to the User’s use of the Functionalities, of any information giving rise to a suspicion that a criminal offence involving a threat to the life or safety of a person or persons has taken place, is taking place or is likely to take place, the law enforcement or judicial authorities of the K.S.A. the in which the offence is suspected to have taken place, where the suspected offender resides or is located, or where the victim resides or is located, and provide all relevant information available or, where we cannot identify with reasonable certainty the K.S.A., the law enforcement authorities of the K.S.A. Xiaomi may also be required to take action upon the receipt of an order to act against a specific item of illegal content by the relevant authorities or to provide a specific item of information about such content to the relevant authorities.

(iii) If the User’s use of the Functionality incurs any transmission or storage of illegal content or any other illegal activities, violate the Terms and Conditions, any other agreement the User entered into with Xiaomi or other relevant policies that Xiaomi may communicate to the User from time to time, or creates potential liability for, or may have an adverse impact on, Xiaomi, Xiaomi may reject, remove, reclassify, suspend and/or limit the access to, or visibility of, the User’s content, whatever ensures effectiveness being least restrictive. In applying these restrictive measures, Xiaomi shall act in a diligent, objective and proportionate manner, ensuring that there are no equally effective and less restrictive means, in applying and enforcing those restrictions with due regard to the rights and legitimate interests of all parties involved, including the User’s applicable fundamental rights. This is without prejudice of Xiaomi’s being expeditious if the cause is that the User’s content entails an illegal activity or contains illegal content. The aforementioned restrictions are implemented by automated means, including algorithmic decision-making and sensitive word verification, and human review, including our community administrators and/or other appropriately qualified staff, for more complex cases and escalation.

(iv) If the restrictions above entail the removal or disabling of access to specific items of information provided by then User in connection to their use of the Functionalities, Xiaomi shall inform the User, at the latest at the time of the removal or disabling of access, of the decision to remove or disable access irrespective of the means used for detecting, identifying or removing or disabling access to that information. Xiaomi shall provide the User with a clear and specific statement of reasons for that decision informing of the type and scope of measure (including whether it was taken pursuant to a notice of illegal content and the legal basis), the automated means used in taking the decision, the redress possibilities available to the you in respect of the decision, in particular through internal complaint-handling mechanisms, out-of-court dispute settlement and judicial redress.

(v)   If the User notices the presence of specific items of information considered to be illegal content in the use of the Functionalities, they may use [service.sa@support.mi.com] to submit a sufficiently precise and adequately substantiated notice of such illegal content. In particular, the User is required to at least provide an explanation of why content is illegal, the indication of the content location, the User’s name and email address and a declaration that the User believes in good faith that the afore is accurate and complete. The User shall promptly be sent a confirmation of receipt of the notice. Xiaomi shall process the form in a timely, diligent and objective manner and notify the User of Xiaomi’s decision in respect of the information to which the notice relates and providing information on the redress possibilities without undue delay.

13.   Xiaomi shall not be liable to Buyer for terminating the service specified point XIII (1) in accordance with the provisions of these Terms and Conditions or Mi Account according to Mi Account User Account Agreement, including terminating Buyer’s account and deleting Buyer’s content on the Website. Xiaomi reserves the right to block access to specified services if the User engages in detrimental actions against Xiaomi, including advertising activities for other entities or products, posting false or misleading content, acting to the detriment of other Users, or violating the provisions of law or these Terms and Conditions. Blocking access to specified services is also justified for security reasons, particularly for breaking the security of the Website or other hacking activities. The blocking duration will be until the issue is resolved. Xiaomi shall notify the User of the blocking of access to specified services by e-mail if Xiaomi has such data.

XIV. Third-Party

1.  Xiaomi may provide links to associated and external entities' websites. Xiaomi is not liable for the content of such websites, and the terms of those entities apply.

2. The User understands and acknowledges that the payment service on the Website is provided by an external entity. The terms and standards of such payment service are determined between the User and the payment service provider.

3. The User accepts that Xiaomi has the right to send information about orders, promotions, advertisements, or advertising links to the User and the recipient designated by them via mail, SMS, phone, etc., solely based on the User's prior consent and in accordance with the Website's Privacy Policy.

4. To facilitate logistics, finances, communication, and related services of Xiaomi, in accordance with the Privacy Policy available on the Website, the User consent and authorize Xiaomi to transfer information provided and created during your account registration and use of the Website's services to other relevant service providers of Xiaomi or to obtain information provided and created during registration and use of related services from other relevant service providers of Xiaomi. Xiaomi may collaborate with external entities to provide related services on behalf of the User. Additionally, for better service provision, product/service recommendation, and market research and data analysis, Xiaomi may disclose User's relevant information to collaborating entities. In such cases, Xiaomi has the right to disclose User's relevant information to such external entities in accordance with the Privacy Policy available on the Website.

XV. Final Provisions

1.  These Terms and Conditions enter into force on April 1, 2025.

2. These Terms and Conditions and all Purchase Agreements and disputes between Xiaomi and the User are subject to (K.S.A.) law, unless the applicable law determines otherwise and the parties submit all disputes to the competent courts in (the Kingdom of Saudi Arabia).The Buyer has the option of filing claims at a competent court in the country in which they are resident.

3. If any provision of these Terms and Conditions is found to be invalid or unenforceable, it will not affect the validity of the remaining provisions of these Terms and Conditions.

4.   Xiaomi reserves the right to change the Terms and Conditions in case of:

(i)    changes in applicable general provisions of law resulting in the need to adapt it to these changes in law;

(ii)   removing any errors and clarifying any ambiguities in the Terms and Conditions;

(iii) issuance of a judgment or other act by a court or authorized public authority resulting in the need to amend the Regulations in order to adapt to such a judgment or other similar act;

(iv) changes to the functionality of the Website;

(v)   organizational or legal changes of Xiaomi.

5.  The User will be informed about changes to the Terms and Conditions at least 14 days in advance by publishing information about the planned change on the Website. If a binding legal provision, judgment, or other similar act of an authorized public authority requires the Xiaomi to make changes to the Terms and Conditions within a shorter period than specified in above, the notice of the changes to the Terms and Conditions will indicate the shorter period, along with the reason. The modified Terms and Conditions apply to the User who made the order or requested Services before the effective date of the changes to the Terms and Conditions.
