Xiaomi Smartphone International Warranty Service for Xiaomi 12 Pro Terms and Conditions

1. Introduction

Xiaomi Smartphone International Warranty Service for Xiaomi 12 Pro (“Campaign”) is organized by Xiaomi H.K. Limited registered at Suite 3209, 32/F, Tower 5, The Gateway, Harbour City, 15 Canton Road, Tsim Sha Tsui, Kowloon, Hong Kong (“Organiser / Xiaomi”).

2. Eligibility

This Campaign is open to all consumers who purchase Xiaomi 12 Pro (“Product”) from a participating authorized sales channel and activated the Product within the Territory as set forth in Table 1 (“Consumer”).

3. Campaign Mechanism

(a) This Campaign shall be valid for a period of twenty-four (24) months from the date Consumer purchased and activated the Product.
(b) Within the warranty period from the date of purchase, if a performance fault that is not caused by a normal use occurs on the Product, Consumer will enjoy free warranty services at the designated Xiaomi authorised service center. Where applicable, any warranty services provided will be subject to the extent permitted by respective local laws and based on the local availability of materials to ensure that the Product can be used normally in the location where the services are provided.
(c) This Campaign shall include the following warranty services:
In-Warranty Repair: Consumer is required to provide a valid proof of purchase and warranty card of the Product for verification purpose. Xiaomi authorised service center will verify and determine whether the warranty conditions are met. Upon successful verification, Consumer will enjoy free warranty services. Warranty services procedures and warranty determination rules may vary by country/region.
Out-of-Warranty Repair: In the event that the warranty period has already expired or the Product is not eligible for warranty services as per this Campaign, any warranty services may be provided for the repair/replacement/modification at the respective local Xiaomi authorised service center with an additional charge. The price of spare parts and labor fee are subjected to the respective local Xiaomi authorised service center where the service is provided. Spare parts available under this out-of-warranty repair shall only include: motherboard, screen, battery, battery cover and others. The availability is subjected to the respective local Xiaomi authorised service center.
(d) Please be noted that the appearance / function of the Product / repaired material may vary as a result of the warranty services provided, and the safety qualification standards / marks for the Product / repaired materials may only be applicable to the places where this Campaign is available due to the requirements of local law so as to differ from the requirements of the law in the place where you purchased the Product.

4. Exclusions

This Campaign will not apply to the following scenarios:
(a) replacements and returns of the Product. Where applicable, other warranty services are subjected to the place whether the warranty service is provided;
(b) if the Consumer refuse to provide the authorization for relevant information, signing of the handover form and instruction form. In such circumstances, Xiaomi authorised service center reserve the right to refuse to provide any warranty services;
(c) Product purchased through unofficial channels. Only Product purchased through an official channel recognized by Xiaomi will be eligible for this Campaign.
(d) any other smartphone model which is not covered by this Campaign;
(e) Product not purchased and activated in the Territory as set forth in Table 1;
(f) Product is counterfeit and has not been manufactured by Organiser;
(g) defect is caused by an unintended use or uses that are contrary to Organiser’s or the Organiser´s instructions, manuals or guidelines;
(h) defect arises from the Consumer’s own or unauthorized repair / manipulation / alteration / modification, or the use of non-authorized or non-original spare parts, software, or components on the Product;
(i) the warranty period has expired at the Territory where the warranty service is provided;
(j) Product cannot be used due to cross-region rather than device failure (for example, it does not support other regional network standards and cannot access the Internet, etc.);
(k) beyond the scope of the statutory service policy of the Territory.

5. Other Terms and Conditions

(a) By participating in this Campaign, Consumer agrees to be bound by this Terms and Conditions and Organiser’s decisions are final and binding. Organiser’s decisions are final and there shall be no appeal entertained and/or allowed. Consumer shall not resort to court proceedings to review Organiser’s decision.
(b) This Campaign is an additional warranty provided by the Organiser during the Campaign Period on top of the existing legal warranty published on https://www.mi.com/global/service/warranty.
(c) By participating in this Campaign and providing the personal data, Consumer indicates that he / she have read, understood and agreed to be bound by the Privacy Policy stated at https://www.mi.com/global/about/privacy/. Consumer agrees that Organiser and/or its affiliated companies and/or its agent and/or its third-party service providers may contact them by telephone, email or such other method in connection in this Campaign.
(d) Consumer agrees and provides consent to the Organiser and/or its affiliated companies and/or its agent and/or its third-party service providers to the use of any personal data as provided by the Consumer for the purpose of participation in this Campaign in line with local personal data protection regulations, to the extent that any personal data provided shall only be processed and be used by the Organiser and/or its affiliated companies and/or its agent and/or its third-party service providers for lawful purpose directly related to the running of this Campaign.
(e) Organiser reserves the rights to modify and/or cancel any of the stated terms and conditions at any time without notice. Consumer are encouraged to check from time to time to view any amendments and/or changes made to the stated terms and conditions.
(f) To the fullest extent permissible by laws, Consumer agrees to discharge and release Organiser and its employees, officers ,directors, shareholders, agents, representatives, parent companies, affiliates, subsidiaries, licensees, advertising, promotion, fulfilment agencies and third party service providers, from any liabilities and claims (including from breach of contract, tort, negligence or any other cause of actions at law or equity) arising out of or in any way connected to this Campaign.
(g) The terms and conditions of this Campaign shall be governed by the laws of Malaysia and the parties submit to the exclusive jurisdiction of the courts of Malaysia.
