TERMS AND CONDITIONS FOR DIWALI WITH MI 2023-LUCKY DRAW:

1. This ‘Smart Shopper-Lucky Draw’ offer (“Offer”) is brought to you by Xiaomi Technology India Private Limited (“Xiaomi” or “we” or “our”). Please read these terms and conditions (“T&Cs”) before entering the Offer. You agree that, by participating in this Offer, you will be bound by these T&Cs and you acknowledge and agree that you satisfy all Offer eligibility requirements as provided herein below.

2. The Offer is applicable for purchases made on www.mi.com and/or the Mi Store App (collectively “Mi.com”) and you stand a chance to win the prizes as set out below.

3. You can participate in the Offer only if you:

(i) can form legally binding contracts under Indian Contract Act, 1872;

(ii) are residing in India;

(iii) purchase an Eligible Product;

(iv) purchase only one unit of the Eligible Product, customers buying more than one unit of the Eligible Product shall not be eligible for the Offer;

(v) possess proof of age, identity and place of residence; and

(vi) the Eligible Product has been successfully delivered and not returned by you

4. You can participate only once in this Offer during the Offer Period.

5. Offer Period: The Offer will be held from 8 October 2023 00:00 hours to 11 November 2023 11:59:59 hours.

6. If you purchase any variant of a, ‘Redmi’ and/or ‘Xiaomi’ branded products (each an “Eligible Product”) from Mi.com during the Offer Period AND your total invoice amount is greater than or equal to INR 2,599 (Rupees Two Thousand Five Hundred and Ninety-Nine), you will be automatically be eligible for the Offer.

7. Subsequent to your purchase, a message shall be sent to your Mi account along with a link to these T&Cs. By receiving these T&Cs, it shall be considered as an acceptance of these T&Cs and confirm your participation in this Offer.

8. Selection of Winners: Xiaomi shall, from the list of participants who have purchased an Eligible Product during the Offer Period and fulfill the requirement under these T&Cs, randomly pick names of five (5) lucky winners from such list of participants through five (5) lucky draws, choosing one winner in each lucky draw (each a “Winner”, collectively “Winner(s)”).

9. Prizes to be won: Each Winner shall be awarded 1 (one) coupon (each a “Prize”) for free products (as per the corresponding table below) that can be redeemed on Mi.com to avail said free products. The details of the Prize to be won and the corresponding dates on which the lucky draw will take place shall be as follows:

*Products to be provided as part of the redemption of the Prize is subject to availability and a possible waiting period. Xiaomi shall not be responsible for any delay in this regard

10. Winners will be informed of the details of the Prize won via call and/or push notifications on their registered mobile numbers as well as their Mi IDs on Mi.com.

11. The Prizes shall be redeemable up to 31st December 2023(hereinafter referred to as “Redemption Period”). We will not be allowing any redemption of the Prize after the Redemption Period.

12. If any attempted notification or delivery of the Prize is returned as undeliverable, or if the notified Winner doesn’t respond within the designated time frame, or if any required details/documents are not submitted within the required time frame, or if the Winner cannot be contacted, verified or found, the Winner will be disqualified from the Offer and Xiaomi will forfeit the concerned Winner’s Prize, and an alternative participant may be declared as the Winner, time permitting. If the Prize is not redeemed within the Redemption Period, the Prize will expire and will be considered as forfeited by the Winner.

13. If you have won any Prize, you must redeem it only from Mi.com before the end of the Redemption Period.

14. The Winner of the Prize shall be solely liable for any tax implications arising out of the Prize.

15. Xiaomi shall not be responsible or be required to provide an additional opportunity to redeem the Prize in the event the Winner fails to redeem the Prize within the Redemption Period. Xiaomi reserves the right to deal with all unclaimed Prizes in any manner as it deems fit. The decision of Xiaomi regarding the Winners of the Offer and the unclaimed Prizes shall be final and binding on all participants.

16. You may need to present the original purchase invoice of the Eligible Product and government proof of your identity to redeem the Prize and to claim the Prize, if required.

17. Xiaomi shall stand fully absolved of its obligations to you upon providing the Prize to you and shall not thereafter be liable in any manner to you and/or your representative in relation to the Offer.

18. While accepting the Prize, you may be required to provide certain details including but not limited to name, phone number, address or any other details that may be required.

19. Employees of Xiaomi and its affiliates, their immediate family members (spouses, domestic partners, parents, grandparents, siblings, children and grandchildren), and employees of Xiaomi’s advertising agencies and Offer partners are not eligible to participate in this Offer.

20. The Prizes are not exchangeable for other rewards, or refundable, replaceable or transferable for cash or credit under any circumstances. The Prizes shall be awarded solely for the Winners’ personal and non-commercial use.

21. Standard manufacturer’s warranty shall apply to the Eligible Product and the Prizes as detailed in the warranty terms for the respective products.

22. Xiaomi reserves the right to alter, modify or cancel any T&Cs herein, or modify, terminate or withdraw the Offer at any time during the Offer Period at its sole discretion without prior notice or assigning any reason thereof.

23. Xiaomi retains the right to contact the participants any time after the expiry of the Offer.

24. This Offer shall be governed by the laws of India. All disputes with respect to this Offer shall be subject to the exclusive jurisdiction of the courts in Bengaluru, India.

25. Customers residing in the state of Tamil Nadu shall not be eligible to participate in this Offer.

26. Xiaomi disclaims all other representations and warranties, express, implied or statutory, including warranties of merchantability, fitness for a particular purpose or use, and non-infringement of third-party intellectual property rights. Under no circumstances, will Xiaomi or any of its affiliates, directors, officers, employees, agents or contractors shall be liable for indirect, incidental, consequential, special or exemplary losses or damages arising from the offer, under tort, common law or under public policy, even if such participant has been advised of the possibility of such damages
