T&C for Clue Plus Trial Offer - Terms and Conditions
("T&C")
General Description
1.1. The Promotion provided for by these T&C is conducted under the name: Clue Plus Offer (hereinafter referred to as the "Promotion").
1.2. The Promotion is organized by Xiaomi H.K. Limited, Suite 3209, 32/F, Tower 5, The Gateway, Harbour City, 15 Canton Road, Tsim Sha Tsui, Kowloon, Hong Kong, (hereinafter referred to as the "Organizer").
1.3. The Promotion is a collaborative offer between the Organizer and BioWink GmbH (hereinafter referred to as "Clue") pursuant to which eligible Beneficiaries (as defined in Section 4) who purchase and activate an Eligible Device (as defined in Section 5) in an Eligible Market (as defined in Section 6) shall be entitled to redeem a complimentary 3‑month subscription (hereinafter referred to as the "Trial Period") to the Clue Plus premium service (hereinafter referred to as the "Offer"). The Offer is provided at no additional cost to the Beneficiary during the Trial Period, after which the Beneficiary's subscription shall convert to a paid annual plan in accordance with Section 2.4, unless the Beneficiary cancels prior to the end of the Trial Period. The Promotion is available only to Beneficiaries who are not Clue Plus subscribers at the time of redemption of the Offer.
1.4. Participation in the Promotion is voluntary and free of charge, except for any internet or data connection costs that the Beneficiary may incur.
1.5. By participating in the Promotion, the Beneficiary hereby confirms having read and accepted: (i) these T&C (https://www.mi.com/global/support/terms/clue-plus-offer("Promotion Page"); (ii) the Privacy Policy of the Organizer (https://www.mi.com/global/about/privacy/); and (iii) the Clue Terms of Service, which the Beneficiary is required to read and accept during the sign‑up process on the Clue platform (https://helloclue.com/terms).
1.6. This Promotion is in no way sponsored, endorsed, administered by, or otherwise associated with any third‑party social media platform, including but not limited to X, Instagram, and Facebook, which may be used for communication purposes only. The Beneficiary hereby acknowledges and agrees to the terms of use, service, or sale and policies of third parties whose platforms are used in connection with the Promotion.
2. Procedure for Redemption of the Offer
2.1. In order to redeem the Offer, the Beneficiary shall undertake the following steps in the prescribed sequence:
(a) Download and install the Mi Fitness application and create or access an existing Mi Account by providing valid login credentials.
(b) Navigate to the "Device" menu within the Mi Fitness application and select "Add device" to initiate the pairing process with an Eligible Device. The Eligible Device must be successfully paired and recognized by the Mi Fitness application prior to proceeding.
(c) Access the "Health" section of the Mi Fitness application and locate the designated Clue Plus promotional banner.
(d) Upon selection of the banner, the Beneficiary shall be redirected to the Clue platform via the Beneficiary's default web browser. On the Clue platform, the Beneficiary shall register a new Clue account or log into an existing Clue account using valid credentials.
(e) During the Clue registration or log‑in process, the Beneficiary shall be required to provide a valid payment method (credit card, debit card, or other payment method accepted by Clue). No charge shall be applied to the Beneficiary's payment method during the Trial Period.
(f) The Beneficiary shall be required to read and accept the Clue Terms of Service (https://helloclue.com/terms) and any associated privacy documentation prior to the activation of the Clue Plus subscription.
2.2. Automatic renewal and billing. Upon expiry of the Trial Period, the Beneficiary's Clue Plus subscription shall automatically convert to a paid annual subscription at the then‑applicable rate for the Beneficiary's region, unless the Beneficiary has cancelled the subscription prior to the end of the Trial Period. Clue shall notify the Beneficiary in advance of the Trial Period expiry date and the applicable annual subscription fee.
2.3. Cancellation. The Beneficiary may cancel the Clue Plus subscription at any time prior to the end of the Trial Period through the Clue application or the Clue account management portal. Cancellation shall take effect at the end of the then‑current billing period. No refunds shall be issued for partial billing periods, except where mandatory applicable law requires otherwise.
2.4. Binding of third‑party terms. The Beneficiary acknowledges and agrees that, following the redirection to the Clue platform pursuant to paragraph 2.1(d) above, the Beneficiary's use of the Clue Plus service shall be governed exclusively by Clue's Terms of Service and Privacy Policy. The Organizer shall bear no liability for any billing, subscription management, service availability, or data processing matters relating to the Clue platform.
2.5. Sequence requirement. The steps set out in paragraph 2.1 must be completed in full and in the prescribed order. Failure to complete any step, or completion of steps in an incorrect sequence, shall render the Beneficiary ineligible for the Promotion. The Organizer is under no obligation to provide the Offer to any Beneficiary who has not completed all required steps within the Term of the Promotion.
3. Term of the Promotion
3.1. The Promotion is available only to Beneficiaries who purchase the Eligible Device, activate the device, and redeem the Offer by March 31 23:59 2027 (local time) (hereinafter referred to as the "Term of the Promotion").
3.2. The Organizer reserves the right to end the Promotion earlier if all Offer redemptions are exhausted. The Organizer shall publish the specific start and end dates, as well as any early termination notice, on the Promotion Page.
4. Beneficiary Eligibility
4.1. To participate in the Promotion, the Beneficiary must:
(a) Be of legal age and possess full legal capacity under the laws of both the country in which the Beneficiary participates and the country of residence during the Term of the Promotion;
(b) Have and maintain an active Mi Account and remain logged into the Mi Fitness application while redeeming the Offer;
(c) Not be a current Clue Plus subscriber at the time of redemption;
(d) Purchase and activate an Eligible Device in an Eligible Market before the Term of the Promotion expires;
(e) Provide a valid payment method when redeeming the Offer on the Clue platform; and
(f) Read and accept the Clue Terms of Service during the sign‑up process.
4.2. The Beneficiary may redeem the Offer only once during the Term of the Promotion.
4.3. The Organizer reserves the right to verify eligibility by requesting proof of purchase, device serial number, or any other reasonably necessary documentation. Failure to provide satisfactory proof within the period specified by the Organizer may result in disqualification and forfeiture of the Offer.
5. Eligible Devices
5.1. The Promotion is open to Beneficiaries who purchase and activate any of the following devices in Eligible Markets:
(a) Xiaomi Watch S5 46mm
(b) Xiaomi Watch S5 41mm
(c) Redmi Watch 6
(d) Redmi Watch 6 Lite
(e) Redmi Watch 6 Active
(f) Xiaomi Smart Band 10 Pro
(g) Xiaomi Smart Band 10 Active
(h) Xiaomi Smart Band 11
(hereinafter referred to as the "Eligible Devices")
5.2. The Organizer reserves the right to update the list of Eligible Devices from time to time. Updates will be published on the Promotion Page. Availability may vary by market.
6. Eligible Markets
6.1. This Promotion is available to Beneficiaries who purchase Eligible Devices in the following markets and who have set their location in the Mi Fitness application to one of these regions: Argentina, Austria, Australia, Brazil, Chile, Colombia, Croatia, Czech Republic, Egypt, France, Germany, Greece, Hong Kong (China), Hungary, Indonesia, Japan, Kazakhstan, Lithuania, Malaysia, Mexico, Moldova, Nigeria, Panama, Paraguay, Peru, Philippines, Poland, Singapore, South Korea, Spain, Serbia, Taiwan (China), Thailand, United Arab Emirates, United Kingdom, Vietnam (hereinafter referred to as the "Eligible Markets").
6.2. Availability of the Clue Plus service is subject to Clue's own regional service coverage and local regulatory requirements. The Organizer does not guarantee that the Clue Plus service is available in all Eligible Markets. Beneficiaries in jurisdictions where Clue Plus is restricted or unavailable will not be eligible for the Promotion regardless of device purchase.
7. Complaints and Dispute Resolution
7.1. Any complaints arising from or in connection with the Promotion shall be submitted in writing to the Organizer, either by email at support.global@support.mi.com or by post to the Organizer's registered address set out in Section 1.2 above. The complaint shall include the Beneficiary's name, contact details, Mi Account identifier, description of the issue, and any supporting documentation.
7.2. The Organizer shall acknowledge receipt of the complaint within 3 (three) business days and shall provide a substantive response within 14 (fourteen) days of receipt, unless a longer period is necessitated by the complexity of the matter or circumstances beyond the Organizer's reasonable control, in which case the Beneficiary shall be notified of the extension and the reasons therefor.
7.3. For matters relating exclusively to the Clue Plus service — including but not limited to payment, billing, subscription management, or service functionality — the Beneficiary shall submit the complaint directly to Clue at trust@helloclue.com. The Organizer shall not be responsible for adjudicating or resolving complaints pertaining to Clue's platform, services, or billing practices.
7.4. Nothing in these T&C shall affect the Beneficiary's right to seek redress through the competent courts or alternative dispute resolution bodies available under the applicable consumer protection laws of the Beneficiary's country of residence.
8. Benefits of Clue Plus
8.1. Compared with Clue's free plan, Clue Plus offers the following premium features. For the most up‑to‑date and accurate information, please refer to the official Clue website in your country or region.
(a) Your period, predicted. Plan ahead, stress less, and get to know your body better.
(b) Track everything from cramps to confidence spikes with 200+ ways to capture how your body feels.
(c) Hormones entered the chat? Periods, PMS, ovulation — spot the patterns and make sense of your cycle.
8.2. The scope, functionality, and availability of Clue Plus features are determined solely by Clue and may vary by region. The Organizer accepts no responsibility for changes to, or discontinuation of, any Clue Plus feature.
9. Personal Data
9.1. In connection with your participation in this Promotion, certain personal data (such as username, first name, surname, email, city or any other that may be required to participate) will be processed by Organizer to the extent necessary to ensure participation in the Promotion, its proper organization, and management (e.g., enabling the Beneficiary to perform the activities required under the Promotion or sending rewards when applicable). 9.2. In addition, if the Beneficiary decides to file a complaint, certain information (such as first name, last name, postal address, or email address) will be processed by the organizer to the extent necessary to manage the Beneficiary's complaint. 9.3. The data will be kept for as long as necessary to fulfill the mentioned purposes, unless the consent is withdrawn. To the extent necessary, some information may be shared with third parties providing us with technical support (e.g., event agencies). 9.4. The legal basis for data processing is the acceptance of these Terms and Conditions in accordance with the mechanism indicated in these Terms and Conditions, as well as the legal obligation the organizer shall comply with when managing complaints, as well as the consent given for the processing of your image and/or social media handler. 9.5. Personal data will be stored only for the time necessary to ensure proper participation and management of any benefits resulting from the aforementioned activities. We will be happy to answer your questions. However, if you are not satisfied with our response, you may also refer the matter to the relevant data protection authority.
10. Liability and Representation
10.1. Organizer's representation. Unless otherwise expressly stated in these T&C, the Organizer and its affiliated or third‑party organizers provide the Promotion on a best‑effort basis only and exclude all warranties and conditions of any kind whether express or implied, to the maximum extent permitted by applicable law. In particular but without limitation, the Organizer and its affiliated or third‑party organizers do not warrant or represent that:
(a) The Promotion is fit for any particular purpose or meets Beneficiary requirements, or that it is provided without any errors or deficiencies;
(b) The Promotion is available to the Beneficiary at any time and provided without disruption, interruption, or delay;
(c) Any information (whether oral or written) obtained by the Beneficiary from the Organizer or as a result of the Beneficiary taking part in the Promotion (including any materials or products) will be suitable, accurate, complete, or reliable; and
(d) Any deficiencies in the Promotion, including any defects in performance, operation, or functionality of the Promotion, will be fixed, corrected, or otherwise remedied.
10.2. Organizer's liability. The Organizer shall not be liable to the Beneficiary, regardless of the legal grounds — in particular whether in contract, tort (including negligence), or any other theory of liability — in connection with the participation in the Promotion for:
(a) Any indirect, incidental, special, or consequential damages;
(b) Any loss of income, business, actual or anticipated profits, opportunity, goodwill, or reputation (whether direct or indirect);
(c) Any damage to, corruption of, or loss of data (whether direct or indirect);
(d) Any changes, modifications, extensions, or limitations (including any suspension of Beneficiary access) to the Promotion; or
(e) Any loss of access to Beneficiary account data or registration data in connection with the Promotion, or any permanent or temporary cessation of the terms or conditions of the Promotion (or any part thereof).
In the event that the Organizer is held liable for a breach of these T&C, the Organizer's liability shall be limited to damages which the Organizer must typically have foreseen at the time of the conclusion of these T&C due to the circumstances known at the time. Notwithstanding the above, such damages shall not exceed EUR 100 (or the equivalent amount in local currency).
Nothing in these T&C shall exclude or limit the Organizer's:
(a) Liability for death, personal injury, or fraud, or in accordance with any product liability act; or
(b) Warranty or liability for damages or losses which may not be lawfully excluded or limited by applicable law. If the laws in the Beneficiary's jurisdiction do not allow the exclusion of certain warranties, terms, or conditions or the limitation or exclusion of liability for loss or damage caused by negligence, breach of contract, or breach of implied terms, or incidental or consequential damages, only the limitations which are lawful in that jurisdiction shall apply, and the Organizer's liability and warranty shall be limited to the maximum extent permitted by applicable law.
10.3. Beneficiary's liability. The Beneficiary is entirely responsible for any breach of the obligations under:
(a) These T&C; and
(b) Any applicable law or regulation in the relevant jurisdictions, including the jurisdiction where the Beneficiary is a resident or from where the Beneficiary is participating in the Promotion;
and for the consequences of any such breach, including any loss or damage which the Organizer or any third party may incur or suffer. The Organizer shall have no responsibility to the Beneficiary or to any third party in respect of such breach.
11. Export Control
11.1. Upon participating in the Promotion, the Beneficiary understands and agrees that the Promotion and the functions, services, and goods provided through the Promotion are subject to the export controls and sanction‑related laws of applicable jurisdictions, containing restrictions on destination, end user, and end use, including but not limited to: (a) the obligation not to use any functions, services, or goods for any activities related to endangering national security and interests, military end uses, support of terrorism, or the design, development, production, or use of proliferation of weapons of mass destruction and their means of delivery; and (b) the obligation to comply with all export, re‑export, and resale restrictions applicable to the goods.
11.2. If the Beneficiary's use of the functions and services provided through the Promotion violates, or in the Organizer's reasonable opinion may violate, the requirements and restrictions of relevant laws, resulting in a compliance risk or adverse impact on the Promotion, functions and services, or supply of goods, the Organizer reserves the right to suspend, restrict, or terminate the provision of all or part of the goods and services.
12. Others
12.1. The content of these T&C is made available to the public on the Promotion Page and at the Organizer's registered office.
12.2. These T&C constitute the sole document setting out the detailed rules of the Promotion.
12.3. These T&C shall be interpreted and applied in accordance with the laws of the jurisdiction in which the Organizer has its registered seat. This does not, however, exclude the application of the mandatory laws applicable in the jurisdiction where the Beneficiary resides, to the extent required by applicable law.
12.4. The Organizer reserves the right to exclude a Beneficiary from the Promotion in the event of: (a) a violation of these T&C; (b) attempted fraud; or (c) any other conduct that violates accepted standards of behavior, jeopardizes the Organizer's reputation or interests. The excluded Beneficiary shall forfeit any right to the Offer specified in these T&C.
12.5. For an important reason, the Organizer may amend these T&C. An important reason includes in particular: (a) a change in generally applicable laws or their interpretation by authorized bodies, directly affecting the content of these T&C; (b) the issuance of a ruling, decision, or similar act by a court or public authority, directly affecting the content of these T&C; (c) the need to prevent violations of these T&C, abuse, or the removal of ambiguities; (d) changes in the names, addresses, or corporate data indicated in these T&C; and (e) the need to adapt the technical requirements to current standards.
12.6. The Organizer shall inform the Beneficiary of any amendment to these T&C no later than 7 (seven) days prior to the proposed effective date of the changes.
12.7. If an applicable law, ruling, or act of a public authority requires the Organizer to amend these T&C within a shorter period than indicated in paragraph 12.6, the notification of the amendment shall specify the shorter period together with the reason.
12.8. The amended T&C shall apply to any Beneficiary who does not opt out of the Promotion before the effective date of the amendment. A Beneficiary may opt out bby notifying the Organizer at the email address specified in Section 7.1. before the effective date.
12.9. An amendment to these T&C shall not adversely affect the conditions of participation in the Promotion. Amendments do not affect rights acquired by the Beneficiary before the date of the change.
12.10. These T&C are effective as of 28 May 2026.
