1. Introduction
This document describes how Xiaomi EV Technology Co., Ltd. and its affiliated companies (hereinafter referred to as "Xiaomi EV", "we", “our”, or “us”) handle your personal information collected by test vehicles on public roads.
Xiaomi EV will use the data collected by the test vehicle to research, develop, and certify the auxiliary features of the whole vehicle or of the vehicle's Assisted driving functionality. For this reason, we need to use the test vehicle's sensors to record data collected from outside the vehicle, including video recordings of the outside environment and your personal information. At present, our test vehicles mainly include data collection vehicles and certified vehicles.
We are committed to protecting your personal information. This Privacy Policy explains how we collect, use, store, and disclose your personal information. 2. Definition of personal information
Under this Privacy Policy, "personal information" means information that can be used to directly or indirectly identify an individual, which can be used alone or in combination with other information about the individual available to Xiaomi EV. It includes information such as name, contact details, identification numbers, location data or online identifiers (e.g. Xiaomi ID). We will use your personal information strictly following this Privacy Policy.
3. Collection, storage, and retention of personal information
Xiaomi EV will not process your personal information for any purpose other than those explicitly described in this Privacy Policy.
Certified vehicles
Xiaomi EV will use certified vehicles to test and certify our entire vehicle and its features to ensure that Xiaomi EV meets relevant European Union quality and road safety standards and other legal requirements.
We will detect and collect information on people and objects in motion in the public transportation environment through external sensors, radar, and cameras, including pedestrians near vehicles, cyclists, people in or on vehicles, and vehicle license plates. In this process, we do not wish to and will not try to identify individuals in any way via collected environmental data.
The personal information we collect about you is necessary for our legitimate business interests. Your personal information is stored only in the European Union. For the purpose of achieving our legitimate interests, we retain this personal information for no more than one year, after which it will be deleted.
Data collection vehicles
Xiaomi EV data collection vehicles driving on public roads will collect relevant traffic data (hereinafter referred to as "public transportation environment data") for research, analysis, and development of advanced driver-assistance systems (ADAS) and assisted driving system software and sensors. The processing of public transportation environment data involves the processing of personal information, and the collection of such data is necessary.
We will detect and collect information on people and objects in motion in the public transportation environment through external sensors, radar, or cameras. This data is used to evaluate sensors and analyze the software used in ADAS and assisted driving systems. These cameras will record pedestrians near the vehicle, cyclists, people in or on vehicles, and vehicle license plates. Xiaomi EV needs to collect data about the real world traffic environment and real traffic conditions in order to achieve the purposes of this data collection. Therefore, the data must be real and cannot be blurred or otherwise modified.
We will not collect data in or at schools, hospital entrances, homes for the elderly, women's shelters, courts, prisons, locations of accidents, beaches, parks, private areas (such as the interior of a house, garden or balcony), and other places that may be sensitive to the person being recorded. We do not wish to and will not try to identify individuals in any way via collected environmental data. We calibrate the collected data so that relevant recorded data can be found, such as notes for sensitive locations.
The legal basis for our processing of the above data is to comply with legal obligations imposed by law and government authorities. The data we collect is stored only in the European Union, and we retain this personal information for no more than one year, after which it will be deleted.
4. Sharing your personal information with third parties
We will share your personal data with the following categories of third parties as needed:
We will share data with entities within our Group for research and development purposes.
We will share data with suppliers, including technical and other service providers, to facilitate the identification, analysis, or correction of some technical errors in the functionality of our vehicles.

We will share data with IT infrastructure vendors that provide us with the means to store and process data.
We may disclose your personal information for the purposes of our legal obligations (including but not limited to law enforcement agencies), or when necessary to establish the facts of a dispute, exercise legal rights, or defend in legal proceedings.
All suppliers will act as processors and enter into data security agreements with us for the purposes set out in this Agreement or in accordance with laws and regulations. We will use standard contractual terms approved by the European Commission to transfer data to third parties outside the European Union. In addition, we will implement additional measures to ensure compliance and security during such data transfers.
We may share anonymized data with other parties. Anonymized data cannot be attributed to natural persons and is no longer considered personal data. We may also share anonymized data or data not attributable to natural persons with research entities for traffic-related research and with road traffic authorities to improve road safety.
5. Legal basis for personal information processing
As expressed above, the personal information we collect about you is necessary for the legitimate interests we seek in connection to the relevant laws and regulations of the European Union for vehicle certification, including European Union Regulation 2019/2144 and European Union Regulation 2021/1958. The relevant regulations include: (1) General safety requirements for automobiles and regulations for the protection of vehicle passengers and road pedestrians; (2) Specific test procedures for intelligent speed assistance systems and detailed rules for technical requirements for automobile approval.
6. Your rights
You have certain rights (referred to herein as "requests") in regards to your personal information held by us. Please note that these rights will be subject to certain exclusions and exceptions under applicable local laws, depending on your location:
The right to access/obtain reports detailing the personal information we hold about you. A copy of your personal information we collect and process will be provided to you free of charge upon your request. For any additional relevant information requests, we may charge a reasonable fee based on actual administrative costs in accordance with applicable law.
The right to delete your personal information. Based on the requirements of applicable laws, you may have the right to request the deletion or removal of your personal information. We shall consider the grounds regarding the erasure request and take reasonable steps, including technical measures. Please note that we may not be able to immediately remove the information from the backup system due to applicable law (for example, where necessary, to save your personal information for potential claims that may arise from or in connection with the processing of such personal information) and/or technological limitations. If this is the case, we will securely store your personal information and isolate it from any further processing until the backup can be deleted or be made anonymous, or until we are no longer legally obligated to do so.
The right to restrict or object to the processing of your personal information. You have the right to restrict or object to our processing of your personal information. For example, if you believe that we have illegally processed your personal information, but you object to its deletion. In this case, your personal information will only be processed if you agree or exercise or defend legal claims.
The right to data portability. You have the right to receive personal information about you in a structured, commonly used and machine-readable format and/or to transmit that personal information to another data controller under certain circumstances specified by law.

For the protection of your information security, your request should be made in writing.
You provide sufficient information to enable Xiaomi EV to verify your identity and ensure that you are the data subject or legally authorized to act on the data subject's behalf.
Once we obtain sufficient information to confirm that your request can be processed, we shall proceed to respond to your request within any time frame set out under your applicable data protection laws.
We have the right to refuse to process requests that are not meaningful, manifestly unfounded or excessive, requests that damage others' right to privacy, extremely unrealistic requests, and requests that require disproportionate technical work, as well as requests not required under local law, regarding information that has been made public, and regarding information given under confidential conditions.
If we believe that certain aspects of the request to delete or access the information may result in our inability to legally use the information for the aforementioned anti-fraud and security purposes, the request may also be rejected.
