Terms and Conditions

1. ORGANIZER AND ACTIVITY

The following terms and conditions (hereinafter "T&C" and/or "Activity Rules") govern the conditions of participation in the Activity entitled "Coolest Service Questionnaire” (the "Activity"), organized by:

(hereinafter, referred to as the "Organizer")

The Activity will be accessible via local Mi Community website: https://c.mi.com/uk/; (hereinafter, the "Activity Page").
The Organizer shall also communicate and promote the Activity through local social media channels.

2. ACCEPTANCE OF ACTIVITY RULES AND THIRD PARTY TERMS AND CONDITIONS

(I) By participating in the Activity, Participants hereby agree to (i) these Activity Rules, as well as (ii) Xiaomi's Terms of Use and Privacy Policy, which can be viewed on local mi.com (www.mi.com/uk) and Mi Community (https://c.mi.com/uk/).
(II) The Organizer reserves the right to amend the T&C in whole or in part for technical, operational or commercial reasons, in which case the Organizer will publish this amendment together with the T&C on its own channels and official media platforms.
(III) In addition, the Organizer reserves the right to exclude from the Activity, and therefore from the award of the Discount Coupon, any Participant who, in its opinion, has participated improperly or any Participant who defrauds, disrupts or disables the smooth and normal and lawful running and operation of this Activity, including those who are proven or suspected to have acted improperly in the manner described above.

b. Third Party Disclaimer and Applicable Terms of Use and Privacy Policies

(I) Participants fully understand and acknowledge that social media or platforms owned by third parties - including but not limited to Twitter, Instagram, Facebook - that may be used in connection with the Activity; do not sponsor, endorse or administer this Activity in any way and should not be associated with this Activity.
(II) In addition, Participants hereby acknowledge and agree that third party terms of use/service/sales and privacy policies - which shall include the Organizer’s business partners - may apply in addition to these T&C.

3. TERRITORY

The Activity is valid in the United Kingdom and for Participants residing in the territory.
(hereinafter, the “Territory”)

4. PARTICIPANTS

You must be of legal age (18 or over) in the Territory in which you reside to participate in this Activity.
To participate, Participants must have a personal and valid Mi Account (the "Participants" and/or the "Participant").
Participation is voluntary and free of charge, with the exception of Internet charges. Inaccurate or erroneous data will not be accepted in the Activity.
Participants must be able to prove, at the Organizer's request and within a reasonable period of time, that they are eligible to participate in the Activity prior to participation and/or at any time during the duration of the Activity. Otherwise, the Organizer may disqualify Participants at any time.
Employees of the Organizer or any company connected with the Activity and/or their family members up to the second degree are not eligible to participate in the Activity.

5. TERM

This Activity starts on Thursday 4th November 2021 at 00:00 hours (GMT+8) to Wednesday 25th November 2021 at 23:59 hours (GMT+8).

6. ACTIVITY MECHANISM

6.1. Description of the Activity

Xiaomi Mi Fans are invited to participate in this promotional Activity “Coolest Service Questionnaire” (hereinafter the “Questionnaire”) available through the Activity Page on their local Mi Community and in which Participants will have the opportunity to share their experience and opinions about what they think is the coolest service Xiaomi offers.
After successfully completing the Questionnaire, other users on the local Mi Community will be able to rate the posts with the answers they consider creative and/or best. The TOP 3 posts will obtain a discount coupon as described in the present T&C.

6.2. How to participate in the Activity

7. DISCOUNT COUPONS

During the Activity, there will be a total of 3 (three) winners (hereinafter "Winner" and/or "Winners"). For more information about the Winners selection, please check point 8 below (“Selection of Winners”).
The Winners will receive a discount coupon to be redeemed on Participant’s local mi.com (hereinafter “Discount Coupon(s)”).
The Discount Coupons will consist of:

*Moreover, there might be two (2) more Winners (fourth and fifth Winner) based on the number of rates. If two Participants got rate amounts very close to the third Winner’s (shall be less than five (5) interactions), the Organizer will also send 50 GBP Discount Coupon to those Participants.

The Winners will receive the Discount Coupon on their personal Mi Account on 26th November 2021.

The use of the Discount Coupons in the purchase of already discounted products or other offers is excluded and not possible.

You can check the details of the Discount Coupon (including validity date, coupon value, etc.) in the "COUPON" section of your Mi Account.

The Discount Coupon is non-refundable and cannot be exchanged for cash in part or in full and is valid for one transaction only. If you return any order purchased in the Activity, the Discount Coupon is also non-refundable.

If you return any order purchased in the Activity, the Discount Coupon will expire.

8. SELECTION OF WINNERS

As described above on point 7, there will be a total of three (3) Winners on the Activity. Winners will be selected based on the number of rates from other Participants and Mi Community users received during the Rate Period.
The Participant with the highest amount of rates will become the first Winner, the second Participant with the highest amount of rates will become the second Winner, and so on.
The Organizer shall also select a fourth and fifth Winner if they obtained rates amounts very close to the third Winner’s, (less than five rates).
Organizer will announce the three Winners on the Activity Thread of Mi Community, which will be selected based on which Posts got the most rates.
If more than one Post have the same number of rates, the Organizer will select the Post which was published earlier on time.

9. INTELLECTUAL PROPERTY

By participating in the Activity, Participants authorize the Organizer to reproduce and make available to the public, directly or through its media, the Participant's nickname and Questionnaire Posts granted by any means whatsoever, always in connection with the Activity and/or advertising purposes related to the Activity. The aforementioned authorization, is granted free of charge and shall not entitle Participants to any consideration.
The Participant is fully and solely responsible for the content he/she posts or communicates through the Activity Page. The Organizer shall not be liable for any infringements and/or violations committed by the Participant in connection with this Activity.

Participants in the Activity agree to provide the Organizer (which shall be deemed to include Xiaomi group companies, parent or subsidiary companies, subsidiaries, affiliates, successors and assigns) with the collection of the following personal data:

11. LIABILITY AND REPRESENTATION

11.1 ORGANIZER REPRESENTATION

Unless otherwise expressly stated in this T&C, Organizer and its affiliated or third-party promoters provide the Activity on best effort basis only and exclude all warranties and conditions of any kind whether expressly or implied. In particular but without limitation, Organizer and its affiliated or third-party promoters do not warrant or represent that:
(i) The Activity is fit for any purpose or meet Participants requirements or is provided without any errors or deficiencies or that the Activity in compliance with any quality levels, as the case may be;
(ii) The Activity is available to participant at any time and provided to Participant without disruption, interruption or delay;
(iii) Any information (whether oral or written) obtained by Participant from Organizer or as a result of Participants taking part in the Activity (including any materials or products) will be suitable, accurate, complete, or reliable; and
(iv) That any deficiencies in the Activity, including any defects in performance, operation or functionality of the Activity will be fixed, corrected or otherwise remedied.

11.2 ORGANIZER LIABILITY

Organizer is not liable to Participant, regardless of the legal grounds, in particular whether in contract, tort (including negligence) or any theory of liability, in or out of the connection with the participation in the Activity for:
(i) Any indirect, incidental, special or consequential damages;
(ii) Any loss of income, business, actual or anticipated profits, opportunity, goodwill or reputation (whether direct or indirect);
(iii) Any damage to and/or corruption or loss of data (whether direct or indirect);
(iv) Any changes, modifications, extensions or limitations (including any suspension of Participants) in the Activity.
(v) Access to Participants account and account data or Participants registration data) taking part of the Activity, or any permanent or temporary cessation in the terms or conditions of the Activitys (or any part of them).
In the event that Organizer is liable for a breach of these terms, Organizer liability shall be limited to damages which Organizer must typically expect at the time of the conclusion of this terms due to the circumstances known at the time. Notwithstanding the above, such damages shall not be higher than 100 euros (or equivalent local currency).

Nothing in these terms shall exclude or limit Organizer:
a) Liability for death, personal injury or fraud or in accordance with any product liability act; and
b) Warranty or liability for damages or losses which may not be lawfully excluded or limited by applicable law. If the laws in the Participants jurisdiction do not allow the exclusion of certain warranties, terms or conditions or the limitation or exclusion of liability for loss or damage caused by negligence, breach of contract or breach of implied terms, or incidental or consequential damages, only the limitations which are lawful in that jurisdiction will apply to the Participants and Organizer’s liability and warranty will be limited to the maximum extent permitted by applicable law.

11.3 PARTICIPANTS LIABILITY

Participant is entirely responsible for any breach of the obligations under
(i) These T&C; and
(ii) Any applicable law or regulation in the relevant jurisdictions, including the jurisdiction where you are a resident or from where you are participating in the Activity.
(iii) And for the consequences of any such breach, including any loss or damage which Organizer or any third-party may incur or suffer. Organizer will have no responsibility to Participant or to any third party in respect of such breach.

12. LEGISLATION AND APPLICABLE JURISDICTION

Participation in the Activity will be governed by the Activity Rules, which will be interpreted and applied in accordance with the law of the Organizer’s country. The Participants have the option of filing claims at a competent court in the country in which they are resident.
